Challenging Carona

The first legal challenge to Sheriff Mike Carona's somewhat suspect personnel decisions has begun. As the Los Angeles Times reports:

A retired lieutenant who supported the runner-up to Orange County Sheriff Michael S. Carona in the June 6 election said he has filed a legal claim against the county, alleging that his dismissal as a sheriff's academy instructor was politically motivated.

Darrell "Guy" Poncy, who taught courses at the sheriff's academy for 15 years, said supervisors told him Feb. 22 that he could no longer teach there because of his "personal attacks against the sheriff."

"I never said anything about him that was personal," Poncy said. "How does he help the academy by firing an instructor who taught about police stress and police suicide? … There was nothing to be gained, except his own personal satisfaction that he could reach out and touch me."

Poncy's claim, the first step toward a lawsuit, comes as the sheriff is being scrutinized over his decision to suspend Lt. Bill Hunt and to demote two of Hunt's supporters. The actions were taken days after Carona narrowly [sic] beat Hunt in the sheriff's race.

(Carona didn't "narrowly" beat Hunt, he beat Hunt and narrowly avoided a run-off.)

The sheriff's department, of course, denies any wrongdoing. A spokesperson told The Times, she was unaware of Poncy's claim, but "any such claim that alleges there was political retaliation is false." The department also maintains that any claim of political retaliation in case of Bill Hunt's suspension is false as well. And as for the demotions of the other two deputies, nothing retaliatory there at all, according to the department.

Regardless of how his claim turns out, Poncy's dismissal really is a shame. You'd think that with everything that's going on with the department, the last thing the sheriff would want to do is get rid of an expert on "police stress".

As a Catholic wife, mother and concerned citizen, I am confused.

Why is Martin Mayer's firm held accountable for posing liability to the County but not other law firms who represent the County while simultaneously representing other politically-connected clients with potential adverse conflicts of interest? I can accept certain priorities but when it concerns the protections and safety of children, the OC Board of Supervisors has a duty to place children at their highest priority.

Guy Poncy has taken the first step toward litigation against the County by filing a claim; however, does this mean that citizens in OC must threaten litigation to get the proper county government agency to investigate reports relating to violations of the law and/or potential conflicts of interest of law firms representing the County?

I have written several letters to the OC Board of Supervisors regarding potential conflicts of interests and the role of the Supervisors to supervise the law firms that represent the County -- to date, I have never received a response.

In addition, there are politically-connected religious institutions that somehow continue to retain employees who are sexual predators and/or have committed crimes relating to failures to report sex abuse crimes or violations of the Gun Free Schools Act. To date, all requests for investigations have been ignored.

Thanks to the OC Weekly, the LA Times, the OC Register for bringing this to the attention of the public.

I will be sending a certified letter to the OC Board of Supervisors tomorrow asking if I must file a claim against the County before an investigation is conducted regarding the reports made. Afterall, what is more important? The protections of children from sex abuse crimes or school zone violence versus wrongful termination liability based on a government employee's termination of employment?

Guy Poncy was one of my coaches. I am an Orange Lutheran runner. I found it very "convenient" that because Poncy didn't support Mike Corona that Poncy was no longer a part of the Sheriff's department. I just think Mike Corona knew what he was doing was completely inexcusable anyone who decided to stand up to him he didn't want to deal with. As a Christian I pray Mike Corona and his family. I pray that he realized what he has done and will that will change his life for the better. I am proud to have been able to have had Coach Poncy as a Coach and Mentor. Thank you Coach Poncy.
