Lock Up Your Daughters: Today All Three Are Free

PhotobucketOn March 10, 2006, Superior Court Judge Frank Briseño sentenced Greg Haidl, Kyle Nachreiner and Keith Spann each to six-year prison sentences for the 2002 videotaped rape and molestation of an unconscious 16-year-old girl. The tape depicted the boys laughing as they sodomized and raped an intoxicated Jane Doe with a Snapple bottle, apple-juice can, lit cigarette and pool cue.

The case made headlines due in large part to Heidl's multimillionaire father, Don Haidl, and Don's political relationship with then-Orange County Sheriff Mike Carona. Read R. Scott Moxley's Haidl Gang Rape archive here.

The boys, then just 17 years old, could have been dealt far worse sentences—they each faced a maximum of 14 years in prison—but two of the three young men, Nachreiner and Spann, are free men today.

Kyle Nachreiner will be released from Chuckwalla Prison in Blythe. Known as one of the most remote prisons in the state, Chuckwalla houses around 3,700 inmates but was designed for only 1,738.

And Keith Spann will return home from the California Rehabilitation Center in Norco, a males-only prison that, according to the Washington Post, is "under nearly constant lockdown to prevent fights" and has buildings "so antiquated that the electricity is shut off during rainstorms so the prisoners aren't electrocuted."

Greg Haidl was released from Pleasant Valley State Prison in Fresno on Jan. 27 after serving about half of his six-year term in a Coalinga prison.

I think the girl after lying to her parents as to where she was spending the night, coupled with the fact she had the previous night slept with each of the defendants, knew what she was putting herself in. Even her friends said she was naked in the pool with another boy the night before. I don't agree with taking advantage of any person who is not in there senses, however I don't call this rape. I call it lewd acts, however the girl should take part of the blame. She didn't report it to the police the next day, she didn't say anything until her parents and her had to discuss her sexual activities and that their 16 year old wasn't only not a virgin prior to July 4th, but she had been sexually active for quite some time. I feel these boys deserve punishment, however not the deep sentance they received. I feel the 16 year old should not have lied and gone over there and started drinking with 3 boys. She is also discusting to me in that she acts as if she is "innocent". I am a rape survior too, but I didn't put myself into that situation. How can any of the players in this ordeal live with themselves, the boys as well as the girl.

I would just like to say that I personally grew up with Keith Spann. He was my older brothers best friend. He was always the good kid. I do not know what got into him. He grew up next door to me in the city of Pomona California. then moved with his grandma. forgot the city. but long story short, i miss the old Keith and wished he never made that stupid mistake =[

I'm just now reading about this case and I find it absolutely INSANE that people won't simply admit that it's wrong to engage in sexual activity with someone who is UNCONSCIOUS!

It really frightens me to realize that people genuinely believe that some people's bodies (their own perhaps?) should be respected, but other people's (whoever they deem) need not be respected in the least.

I was always taught to treat people the way I would want to be treated. True, that sometimes means treating people better than they treat themselves but a little more of that would make the world such a better place, don't you think?

I say this girl was as guilty as these guys. This is a clear example of a slut who puts out for 3 guys & says nothing until her folks find out. There's no question she was forced into this by her father. It's amazing it got this far, though I shouldn't be surprised at our legal system with its celebrity hungry & career advancing prosecutors who'll do anything to get their names in front of the public. Also the incredible hypocrisy of a society that laughs at those recommending abstinence for teens while promoting all kinds of sexual "freedom", then having the nerve to lower the boom on kids when they act out the very stuff they see in front of them every day, with the approval of the very state that wishes to lock them up. Incredible. None of these kids should have gone to prison. I don't know how this girl sleeps at night. As for their abuse in prison, it didn't happen. Pleasant Valley is specifically for those inmates least likely to be violent. Those who wanted this to happen, well, they are worse than any rapist themselves. Another morality play from the land of fruits & nuts. Also this girl was busted for methampohetamine possession. yeah, real innocent.

I just saw this on tv and I can't help but wonder one thing. She drove there at midnight. And then the story on TruTV later said that one of the boys drove her home the next morning. Why would that be? My only guess is because they knew she still was not conscious enough to even drive the 20 minutes home. That right there raises a red flag.

The other thing that bothers me about this is that on July 4th, Mr. Haidl (the father) came out and told the boys they needed to break it up and they said yep no problem just finishing up this game. And yet the party when on hours later. The next day nothing was ever said about the alcohol consumption or the lack of it remaining? And so at midnight July 5th/6th, again the father asked if they were going home and was told yes and again he turned his back and the boys disrepected him and this is what happened. So obviously the father was not at all in control of his son and even may have allowed the alcohol consumption at home. If these boys can't even respect their own parents and lie to them how do you expect them to respect a woman whom they only know through casual sex?

It does not matter what Jane Doe did prior to this night. She should not have been the one whom was on trial. She was the victim but as always, defending lawyers always try the victim because that's easier than defending the accusations of their client.

Ironically, had this girl decided to drive home before the video tape incident and struck someone killing them with her car she would be held 100% responsible for her actions even though she would have been just as uncomprehending as she was for the making of that tape. There is no excuse in the world for rape but it is not those boys fault she got herself too drunk to understand what was happening...not when they had already consumed a 12 pack each before she even showed up so I am sure unless she was a really heavy drinker that she managed to get herself more messed up in the head than they already where. Had those boys been sober then it would be different. Or even had not drank as much as her. Sounds to me like they were all being stupid and she just regretted it when Daddy found out about the tape. I have seen enough drunk people to know that people can look like they are still functioning but they don't have a clue what is going on around them or to them. They made themselves that way and they need to understand that when they allow themselves to get that drunk that they may very well have to pay the consequences. We should not teach people that they can just blame someone else for their bad choices or when things happen that they don't like.

If you watched the TruTv special thats the whole reason the first trial couldnt reach a verdict, because the jurors, all but 1, saw that she showed signs of being physically and emotionally stable. This whole situation is unfortunate, for the girl, and the boys. While I can understand how consensual, drunk, group sex can turn into something foul in a hurry, I can't feel for the guys. The ONLY reason these guys got caught, was because Greg had the nerve to show it off to people. Any decent person who made a horrible drunk mistake wouldn't go around flaunting the video, laughing about it, taking pride in it. So as much as the circumstances under which they'll all be labeled sex offenders until the day they die are unfortunate, none of this would have ever happened if Greg weren't such a scumbag when he was 17.
