Judge in Jailhouse Murder Case Failed to Disclose Conflict; DA Should Drop Case, Motions Claim

The case of the brutal Oct. 5, 2006 murder of John Derek Chamberlain, who died at the hands of fellow inmates at Theo Lacy Men's Jail who believed he was a child molester, is already sensational enough. Although only nine inmates have been charged in his death, both the suspects as well as Orange County Sheriff's detectives and prosecutors agree that dozens of prisoners participated in the vicious attack, which lasted at least half an hour and involved repeated punching, kicking, stomping, sodomy with a pencil and dousing with scalding liquid--all under the not-so-watchful eyes of jail guards, who later acknowledged they were just 30 feet away, watching television, playing Nintendo and texting their girlfriends.

And then there's the testimony--provided by several witnesses and bolstered by other evidence--that Chamberlain, who had been arrested a few weeks earlier on charges of possessing child pornography, knew his life was in danger and asked guards to relocate him on the day he died, only to have one of those guards, Deputy Kevin Taylor, allegedly tell the white "shot-caller" in the barracks where he was housed that Chamberlain was a child molester. That shot-caller, Jared Petrovich, previously shared his story about Taylor with the Weekly here, and now, along with the other inmates charged in the murder, he faces life in prison.

But now the case is getting even more bizarre. According to a motion filed on Jan. 22 by Keith Davidson, Petrovich's attorney, Judge James A. Stotler has a conflict of interest in this case and should immediately remove himself from it. On Jan. 8, more than a year after being assigned to the case, Stotler informed Davidson and other attorneys that he used to be a client of Al Stokke, the attorney representing defendant Michael Garten, one of the inmates being charged in Chamberlain's murder. Davidson's motion argues that this presents a major problem for his client because Garten provides key testimony against Petrovich.

As Petrovich previously told the Weekly, he acknowledges telling other inmates that Chamberlain was a child molester and specifically, that Deputy Taylor wanted them to assault the inmate that evening, but only to injure him between the waist and neck. Garten and other inmates corroborate that claim. "Garten incriminates Petrovich when he informed authorities that Petrovich lied when he claimed he never touched Chamberlain in the deadly attack," the motion states, as well as when "Garten incriminatingly told authorities that Petrovich was minimizing is involvement in the attack and events leading up to it."

"Petrovich is alleging that there is either judicial partiality or a substantial likelihood of that the public would perceive judicial partiality by Stotler because of his longstanding relationship with Stokke and the fact that he was formerly represented by Stokke," Davidson told the Weekly this morning. "And the fact that makes this whole thing sour is Stokke has been representing Garten for 13 months and only now does Stotler come forward and say 'Oh, by the way, I happen to have an attorney-client relationship with one of the lawyers and you should know this.' This leaves my client and my client's family with a sense that they are not being treated fairly." Davidson added that attorneys for Chamberlain murder defendants Eric Miller and Stephen Carlstrom planned to join his motion to have Stotler remove himself from the case.

Reached by phone today, Stokke refused to comment on Davidson's motion, citing attorney-client privilege--the client in question being, of course, Judge Stotler. However Stokke did comment in detail on a motion he filed last week in the case requesting to have the Orange County District Attorney's Office taken off the Chamberlain case. The motion points out that in the Chamberlain murder case the agency decided to investigate itself. Typically, the DA's office investigates any homicides inside county jails, to avoid any conflict of interest. However, as Stokke's motion argues, then-Sheriff Mike Carona (now ex-Sheriff and convicted felon) ordered his agency to do the investigation, and the DA's office failed to do its duty by alerting the Attorney General, instead, opting for a special grand jury probe that, while unearthing overwhelming evidence of a cover-up, failed to indict a single deputy, instead charging three more inmates with Chamberlain's murder.

"[T]he acquiescence in the face of the conflict-filled investigation, the violation of Protocol, the subsequent failure of the District Attorney to notify the Attorney General, and the failure to initiate any proceedings against those who brazenly mocked the Grand Jury process is directed at one goal, the protection of 'its own' (i.e. law enforcement)," Stokke's motion states. "However, such action (or inaction as is sometimes the case) geared to protecting those who wear green (the color of the Sheriff's Department's main uniform) at the expense of those who wear mustard (the color of standard jail-issue uniforms) is 'outrageous' and it is my belief that such conduct on the part of the DA offends our society's fundamental assumptions about fairness, justice and due process of the laws."

As if Corona & Taylor weren't enough...now these guys have been awaiting trial for years and the judge hasn't said anything until now! WTF!!!

Thank you to the OC Weekly and Nick Schou. It is obvious that its business as usual here in OC's law enforcement community. Careers are ruined, reputations are destroyed, families are divided, and the attorneys for the OC District Attorney (who is an attorney) and the OC Sheriff may continue to abuse the judicial process and obstruct justice, while the public's safety is placed at serious risk. The corrupt attorneys are laughing all the way to the bank.

Maybe the U.S. Department of Justice and the FBI will get to the bottom of this corrupt county.

These guys are facing life because they did what Deputy Taylor told them to do, and somehow he gets off scott-free?

It is hard for me to understand how such a tragedy could take place in a controlled environment, with three guards on duty. I do not understand the politics or the jail systems of hierarchy. From what I have read and heard from others, it designed to keep some sort of peace and order among the jailers and the inmates. Sound’s like in this case, the system was abused from the top ranking officers in charge, and instead of keeping peace and order, was used for a different purpose of amusement.
Now, to make matter's worse, the judge kept this information for over a year before disclosing it..Sounds like enough evidence for a mistrial...CASE DISMISSED!

The motion is scheduled for tomorrow, January 26, 2010, at 9:00 am, OCSC, Dept. 41, before Judge Stotler.... the public can witness OC proseutors and defense attorneys attempt to salvage their legal reputations by explaining to the public why they took over one year to speak up about a Judge's potential conflict of interest.

Judge Stotler may be the first Judge on the OCSC bench who actuality thought about a potential conflict of interest, even though it took 13 months for the Judge and the defense attorneys to register a concern.

Judge Goethals presides over the criminal division in OCSC, Dept. 5. Attorney Gary Pohlson is Judge Goethals' former law partner. Does anyone recall whether Judge Goethals and/or Attorney Pohlson are held accountable to violations of conflict of interest statutes?

It is my sincere hope that this new legal technicality does not allow the OC District Attorney, OC Sheriff and the Orange County Superior Court bench to sweep the murder of John Derek Chamberlain on 10/5/06 out of the public's view. Where there is smoke, there is fire----and the public is getting sick and tired of watching corrupt law enforcement officials and attorneys escape accountability in a court of law.

Tomorrow will be an interesting day... more fair and equal justice in Orange County courts of law (NOT)!

To discusted: I feel the case has been so mismanaged...with cover-ups, missing evidense,the abuse of power, that the case should be dismissed. The inmates were used as pawns for the amusement of the guards on many occations, the sheriff's dept needs to take full responsibility for their actions, it's just too bad it had to take a tragedy for there disobiediance and neglect, and no reguard for human life to surface.

And let's not overlook the DA's office, who was apparently wearing 2 hats, investigator for the sheriffs dept (which has clearing been shown to be corrupt beyond belief) and now the prosecutor.

This case has been a tragedy of errors from the night of Oct. 6, 2006 to the present.
One thousand two hundred and fifty seven days. One man dead. Young men in a jail, most of them in their early 20's in 2006, now closer to 30. At 20 perhaps willing to do almost anything to get on a guards good side, without thoughts of the consequence. At 30 thinking how could things have gone so wrong. Deputies just as guilty, but free to continue to profess their innocense. And now a judge with a conflict of interest. Not only a conflict of interest, but it seems to me to have denied the inmates their right to a speedy and fair trial.
This case is so tainted at this point, there will never be a fair trial, and so many lives have been damaged that normal is a distant memory. Yes, this judge should step down and these defendents should be on their knees praying for a fair and honest judge to step in.

Your over-enthusiasm for data that has been collected and complied by policing agencies tells me either 1) you work there, or 2) you are an undergraduate student who has taken a criminal justice class, but not yet gotten to the “methodology” part of your curriculum where they teach you about reliability and validity problems with official crime statistics.

Well let's take a look @ this...genius. Stat is a stat. You take random samples of jails from across the country with similar populations and do something awesome....you ready for this? You compare stats! It's so easy!

Take for instance jail #1 in BFE Texas with a jail population of say 3,000. You collect their data in regards to inmate on inmate violence, suicides, attempt suicides (etc...) over a period of time and....get this....COMPARE data to ocsd's! Totally rad!

Then guess what...you do it again with another jail or jail system. Wow, I feel so learned!

Of course silly, there are many crimes that go unreported. But unlike the streets, the jails are pretty well controlled and monitored which makes the chances of observing one of these 'unreported' fights a lot greater, which in turn becomes a....yup, you guessed it...a stat!

I'm just comparing Department of Justice facts...sorry to disappoint you. Hey, I got a great idea. How about you, instead of suggesting fault in a system of collecting records, come up with something new and improved! Or are you just one of those gutter punks that sit around waiting for a protest, smash a window in the name of anarchy and then go home (maybe get a coffee @ bucks on the way), play call of duty on your PS3, and then post anti gov't propaganda on your local newspaper blogspot. Good Day! -=)

When this happened a friend of mine was at the Main jail serving time for not finishing his Cal Trans. When he got out he came over and visited us. I hadn't paid much attention to the news on this story because not a lot had been written about it. He and I were talking and he was telling me how much OCJ had changed since he'd last been there maybe 10 years before. Anyway, he told me about an inmate that had been transferred to the main from Lacy waiting to be released in custody to state prison. He told me the story this inmate had told him about a guy who had been killed by other inmates, because a deputy had told one of them that the guy was a child molester. He said that the guy was every color under the rainbow after the beating. That he had tried to crawl under a bunk to get away from the fists and the feet that were pummeling him. He described how every time he would pass out, he would be dragged to the showers and revived so that he could be beat some more. He said that one of the victim's eyeballs had literally popped out of the socket from being jumped on from inmates who got on the top bunk in order to stomp him harder by jumping on him.

He also explained the politics of how these things are carried out. See, because John Chamberlain was white, it was up to the white shot caller to initiate the whites to beat him up for being a Chester. The reason for this is to avoid it becoming a race riot. In the case of Chester's the Southsiders (American born Mexicans) and the group that covers the border brothers or Mexican born Mexicans, can take punches AFTER the Whites. This is considered politically correct in jail.

What my friend relayed the inmate who he talked to who came from F Dorm to the main, is that these protocols were carried out in that way. He said that Southsiders opted out for the most part because there was no paperwork and they didn't want to take the word of a cop. Some participated but they were ordered to by their shot caller. The border brothers (I can't remember what they are called) came in after the whites and were the ones climbing to the top bunk and jumping down on Chamberlains face and head and body, they were taking him to the shower and reviving him so they could beat him further.

By the time the inmate got the deputy's attention by yelling "Man Down". The inmates had attempted to get rid of evidence by showering, themselves and their jumpsuits and shoes. I asked him what happened when the deputy came in and he said that one of them practically screamed, "What the Fuck did you guys do?!" and that one of the inmates yelled back, "You told us to!"

The riddles of this case as Petrovich's lawyer calls them are that the death of John Chamberlain probably occurred while the border brothers were beating the crap out of him (literally). The motive to this murder has so far been allowed to walk with no charges brought against him. So, how is their a case when you let the motive walk free? How is there a case when the cause of death probably all high tailed it over the boarder upon release?? This case was botched up from the get by the balless DA allowing the Sheriff's department to lead its own investigation against itself for even two minutes.

This case isn't just riddled, its a fucking joke.

Same goes for anyone with indirect knowledge, including you, justiceforall. I've already heard from official sources that they feel my writing on this topic is one-sided, so I'm going to do everything I can to get the other side of the story in print as well. The DA's office continues to claim that they'll prosecute anyone who helped ensure Chamberlain's doom, whether they be inmates or deputies, if enough evidence arises to prosecute said person. Don't hold your breath on the deputy part of that statement, but do stay tuned...much more to come...

How reliable do you truly think the stats reported by OCJ -about OCJ- really are? Most of OCJs funding sources (state, fed, grants) are based on stats and numbers - and most of us know by now that numbers DO actually lie. I hate to share this, but the world is full of ugly stuff like intentionally reporting false stats. (Recall the banks, Enron-style budgets, etc. SunPower is being sued right now for doing it...)
Life has a lot of lessons for you, kid.
