An attorney for the 23-year-old Riverside man has filed a change-of-venue motion in Orange County Superior Court.

Stewart's silver Mitsubishi was clipped by a red minivan at the intersection of Orangethorpe Avenue and Lemon Street before slamming into a light pole. A third car was also smashed at the same intersection, although its driver was unharmed.
Stewart, Pearson and Adenhart, who hailed from Silver Spring, Maryland, died at the scene. Despite suffering internal decapitation, Wilhite has miraculously survived.
The minivan driver fled the scene, but Gallo was later apprehended and initially arrested on suspicion of felony hit-and-run. The Orange County District Attorney later charged Gallo with three counts of murder, driving under the influence of alcohol and driving with a suspended license because of a prior DUI conviction. He has pleaded not guilty.
