Guy Goes to Jail to Give Money to Wife, Leaves 3 Kids in Car, Then Goes to Jail Himself: Cops

Gerardo Jose Jimenez was held on $100,000 bail.
A man with a star tattooed over his throat illegally parked his car in front of the Orange County Jail in Santa Ana Monday afternoon to put money in his wife's jail account.

That only would have earned 29-year-old Gerardo Jose Jimenez a parking ticket were it not for this: left unattended in the vehicle were his three daughters--an 8-month-old infant, a 21-month-old toddler and a 7-year-old girl, according to police.

That move sent the Garden Grove resident to jail himself for alleged child cruelty.

An off-duty Orange County sheriff's deputy called police around 5 p.m. Monday after spotting the girls inside a Honda Accord parked outside the jail at Sixth and Flower streets, according to Cpl. Anthony Bertagna, the Santa Ana Police spokesman, who added the car's windows were rolled down and the engine was turned off.

The deputy asked people in front of the building if they were related to the children (negative), then went into the jail to see if he could find a parent, which led him to Jimenez, who explained he was the father of the girls and not to worry because he left the air conditioner on, Bertagna related.

Of course, if the engine was off ... well, you get the idea.

Anyway, Jimenez told cops he couldn't find anywhere to park, didn't want to take the children into the building with him because his youngest daughter was asleep and wouldn't be in the jail facility very long, Bertagna said.

But leaving them alone at all is against the law, noted the police spokesman, who added that investigators believe the girls were unattended for at least five minutes before the deputy spotted them. It was about 80 degrees outside at the time, Bertagna said.

Jimenez was arrested on suspicion of child cruelty and held in lieu of $100,000 bail. The kids got a trip to Orangewood Children's Home.

Desperation or hopelessness rarely stimulates a person's best thinking or actions.

When it rains, it pours.

Yes, protect the kids but have some compassion.

How about adequate parking?

How about volunteers at jail and an area to child sit?

The star most likely means he's done a "bullet" (one year) in OCJ, in the past.  Nothing new to him, but sad for his girls.

So many people hating on this guy, but I think we should be a little more sympathetic. We didn't have a deadly heat wave, and the windows were down, so I don't think anyone dying from overheating is a valid concern.

Could they have been kidnapped? Maybe, but as others have stated, this is a jail with lots of cameras and police so it's unlikely.

The biggest fear I'd have is that the 7 year old doesn't do a good job baby-sitting the other 2, or that the 7 year old wanders off. The sad fact is, this guy sounds like a single dad watching 3 kids. That 7 year old is probably already helping a lot to take care of the 2 babies and has had to grow up really fast.

Don't like it? Neither do I, but that's what poverty looks like. This guy is already struggling; having the book thrown at him for this might be an overreaction.

Don't put anything past what people will do to get a child. You obviously don't have children because I can tell you right now I'd never leave my infants in a car unattended regardless where it was. And another point is if he is stupid enough to leave children unattended at a place like that, what does he do when no one is looking. Glad he was caught and those children taken. Hopefully this is a huge wake up call for him and he thinks before doing something so careless next time. And I would hope that the kids are with other family members and not in foster care, which is what CPS strives to do.

Not very smart parents at all. The kids should go to relatives or foster care for a long long time

Agreed! I'd wait in the car all of the time because I hated shopping with my mom. I get it's not the wisest thing to do, but definitely way too hard a punishment

What ever happened to giving someone a warning and telling them not to let it happen again? This guy probably was rushing to get there before 5. He couldn't find parking, he parked illegally because he didn't want to leave his kids alone 4 blocks away in the parking structure. If he'd left them alone at home to do this, he would also have been breaking the law. He's a father with two infants and a young kid - it would be a lot cheaper to give him some childcare and some family support than put him in jail and put his kids in a childrens' home where god knows what will happen to them. What a ridiculous, broken system we've created.

What the hell is wrong with that guy. Not only did he put the lives of his children in immediate risk by leaving them in the car, he further jeopardized his children by getting himself locked up for it. This is his fault and not the fault of the police. it is ridiculous to think otherwise. He is responsible for his actions. I would not leave my kids in the car to pay for gas let alone to go into a building for any length of time.

Stupid, stupid decision to leave your babies unattended...this guy deserves to be behind bars!

Julie Peters Dohrman

I think those of you defending him have not read the article. He left 2 babies and a 7 yr old alone. It's not like he left teenagers in the car or older school aged children for that matter. He left BABIES alone. These children couldn't defend themselves had someone approached the car with ill intent.

Richard Cendejas

Yeah, let's punish the children by placing them in foster care where they can be raped and tortured. Seriously connect your brain, 80f with the windows down shouldn't be a crime. Jury nullify any charges.

Take your fucking kids inside the building. It's not hard. It's inconveinent at most. But, you know what? Having kids can sometimes be inconveinent. There have been plenty of times my toddler was alseep in the back of my car and I needed to run into the store to get 1 little thing. So, I had to calculate what was the bigger problem, waking my kid-up to go into the store or not getting the thing. Never did 'leave her in the car' make it into the top 10 options.

Did you not read the part that the children (two of which are babies) were left UNATTENDED in the vehicle???  If you seriously made that comment knowing this then you also belong in jail.
