Cesar Gerardo Marta Guilty of Murdering Santa Ana Man Who'd Fought with Killer's Daughter
Update: Cesar Gerardo Marta lost his bid for a new murder trial on grounds that he had ineffective counsel because he was advised not testify on his own behalf. Orange County Superior Court Judge Thomas Goethals agreed with Senior Deputy District Attorney Susan Price that there was no evidence 42-year-old Marta did not know he could request a new lawyer. The Omaha man is scheduled to be sentenced Friday for the murder of 27-year-old Cesar "Danny" Gutierrez Hernandez, who was stabbed seven times in front of his Santa Ana home on May 26, 2010. Marta faces up to 30 years in prison.
