Kim Pham Trial, Testimony From Days One and Two: Two New Videos and Three Independent Witnesses

The prosecution in the Kim Pham trial closed the first two days of its case today with two more new videos of the altercation and testimony from the third witness not to have an affiliation with either Pham's or Vanesa Zavala and Candace Brito's groups. The takeaway: All three of the unaffiliated witnesses believe that both Zavala and Brito kicked Pham in the head shortly after midnight Jan. 18 and that after the last kick, Pham became unconscious.

The three young men were together in a group ahead of Pham's in line at the Crosby the night she died. Two of them recorded video of the altercation.

The new videos shown in court today show the end of fight. The first one opens with "Emilia" and Pham on their knees of the side walk pulling each other's hair and punching, with many people rushing around them. Then someone appears to kick Pham in the head, after which she falls limp. The video cuts quickly after that. The second video shows some of the fight that broke out after Pham fell unconscious. The camera rushes up to a knocked-down Pham as many people, the camera man among, urge someone to put Pham on her side to avoid blood aspiration.

Aaron Renula was the cameraman of both videos and the prosecution's last witness of the day. He said that he saw Zavala and Brito kick Pham in the head, in line with testimony from his two friends Darwin Arayata and Patrick Madriaga the day before. He testified that he had trouble sleeping after the incident.

However under cross-examination by defense attorneys Kenneth Reed and Michael Molfetta, all three men conceded that their lines of sight were blocked by people circling the women fighting and that they never saw a kick actually land, they only inferred what they knew through body movements.

The prosecution will recommence on Monday. In addition to the three friends, they have also already called the first responders and the Santa Ana Police Department detectives who interviewed Arayata and Madriaga to the stand.

This is all around a sad tragedy for both sides.  Several bad choices leads to death and prison time.  NEITHER party is innocent and one bad judgment escalated to another.  On another side note, Its very sad how cruel the internet can be- with all the name callings...this incident could have happened to anyone - drunken nite at the bar and getting into a fight and/or helping a friend who is in a fight and/or overly defending yourself by using excessive force, which results in serious injury and or death- and because of that ur now labeled the worst person in world??  I'm sure these girls didn't go to the bar thinking "i think I'm going to kill someone today" It happened and yes it may have been overly excessive...but there will be consequences for their actions- jail time...AND the victim would still be here today if she just walked away rather than start the fight.

This case isn't weak you crack smoking Meheecan!  It doesn't matter if all these witnesses say that they did not actually see these two burritos connect their dirty feet to the eggroll's head.If it was only these two burritos doing the kicking then it's direct evidence of them kicking and circumstantial evidence that is was them that landed the kicks that killed the skinny eggroll.They were not attacked by the eggroll and had no right to be kicking and stomping her.If they were the only legs kicking and stomping away then there's no other perps out there but them.  Both of these burritos aided and abetted each other in inflicting great bodily harm against the little eggroll filled and are both guilty of causing her death, it's only a matter of degrees.

This case reminds me of the retired security engineer in the mid west whose home had been broken into multiple times.  The two cousins broke into his home again on Thanksgiving. Unbeknownst to them, the homeowner was lying in wait in his basement.  While he was well within his rights under the Castle doctrine to defend his home, he crossed the line for shooting both of them in the head after the perpetrators were already down.

It does appear that Kim Pham was already down too when the fatal kick to the head was administered.  That is not self defense as Pham was no longer a threat.

what a weak case. i would think the da's office would have witnesses saying they saw them kick her in contrast to having a suspicion.

@tnje  Very well said!  I agree 110%.  This could have happened to just about ANYONE!  And it is very unfortunate that the internet has been flooded with so much negativity, racism and nonsense directed at this trial. 


My opinion of the bystanders is that they too should be charged with a crime - they stood around and encouraged the fight to continue and even grabbed their phones to record the incident with the intentions of posting it online. Perhaps that isn't a crime, but it should be, in my opinion.  I hope those people continue to lose sleep knowing they could have saved a life!

@meheecan-cris-doner  "what a weak case." That is a fact for the jury. The defenses case is silly, it is like saying he shot the gun and the other fellow fell down dead, but I did not see the bullet.


When is the prosecutor going to bring forth the testimony about the 2 women's group of people leaving and coming back more than once.
