As OC Deals with Flood of Concealed-Weapon Requests, Moms Group Seeks Ruling's Reversal

Categories: Court, Politics

Hutchens Cover.jpg
No sooner had Orange County Sheriff Sandra Hutchens announced she had dropped the "good cause" standard for issuing conceal carry permits after the requirement was struck down in a state appeals court that moms are calling for the reversal of that ruling.

Specifically, it's the state chapter of Moms Demand Action that claims if the ruling by a three-judge panel of the U.S. Ninth Circuit Court of Appeals stands, "this will fundamentally change public life in California."

California law had left it up to the discretion of county sheriffs to decide whether applicants had good cause to carry concealed firearms before issuing permits to do so. Hutchens was among the sheriffs who adopted the good-cause standard.

But the requirement was struck down Feb. 13 by a 2-1 vote of a panel of the U.S. 9th Circuit Court of Appeal, which found the Second Amendment bars such a requirement.

After Hutchens announced she would immediately abide by the ruling, her office was flooded with more than 500 requests for concealed-weapon permits, so many that the sheriff's department is now planning to hire retired deputies to process the applications.

Now comes Moms Demand Action contending that while other states may be able to safely deal with concealed-weapons holders, California has little experience with such a lifestyle.

"This will fundamentally change public life in California, where dining in restaurants, riding on a train, or standing in a checkout line next to someone carrying a loaded firearm is not customary," says Catherine Stephani, California chapter leader for Moms Demand Action, in a statement. "Other states live this reality, but this has not been our way of life in California."

If the ruling in Peruta v. County of San Diego stands, up to a half-million more guns may soon be in the streets of California, she warns.

moms-demand-action_logo.jpg
"We often say we are lucky to live in California because we have some of the strongest gun laws in the country," says Stephani. "Despite the size and complexity of our state, we have one of the lowest rates of gun-related mortalities in the nation. This is largely attributable to our tight gun laws that balance both Second Amendment rights and public safety."

She pointed to statistics that "show clearly" more guns do not make us safer.

"We must let our leaders know at every possible level of our government that we refuse to allow the reversal of the very laws that have helped prevent gun violence in California," Stephani says. "Our moms call on all Californians to speak up now, for the health and safety of our families and communities."

You can learn more about her group at www.momsdemandaction.org, www.facebook.com/MomsDemandAction or via Twitter at @MomsDemand.

Keep in mind a Roseville-based group called Firearms Policy Coalition has posted a Change.org petition and open letter to Mark Zuckerberg calling Moms Demand Action a "hate group" that is hellbent on removing pro-gun content from Facebook.

If anyone cares what the founding fathers said, they did say that in order to have a free and secure state, there should be no infringement of the right to keep and bare arms.  So, isn't it an infringement to have to ask the police for permission to bare arms?  You know, in case anyone does care about what they said.  Probably nobody does, though, because I never hear anyone point this obvious fact out.

Direct from my email inbox, this open letter:

To Ms. Catherine Stephani & Ms. Shannon Watts:

It’s completely understandable wanting children to live in a safe environment, which begs the question, why don't you want to ensure their safety? I'm quite certain that if you were unfortunately put in the position of having to rely on an armed person with a concealed weapon permit to protect you and your children, there would be no objection on your part.

The unfortunate reality is that we live in a world where evil exists, and from time to time, that evil manifests itself inside someone determined to cause mass destruction and inflict maximum pain on others. Your advocacy for disarmament has led to increased mass shootings as the public is forced to rely on police, which have no legal requirement to ensure your safety, to react to the situation minutes after it transpires, causing the lives of many to be unnecessarily lost all because you want to feel "safer".

Having children doesn't give you any right or special privilege to prohibit others from securing their safety and protecting their lives and the lives of the ones they love. It’s disturbing that you've resorted to draconian methods of silencing debate on this issue, which demonstrates you don’t want a debate, you just want control. We've been warned about people like you, who would sacrifice our liberty for a little safety. As history shows, we’ll lose both and in the end, the very thing you think you’re protecting, the safety of children, will be lost. Can you live with that?

This group is a small minority of OC moms who could benefit from joining the huge trend of more and more women getting trained. The rest of the country gets it now and California will soon join them with more guns (and less crime).

On the facebook link for this story, the caption pic is a fat old shirtless guy, slumped down sloppily on the couch, pointing a gun at the camera. A law is deemed to be unconstitutional, an infringement on people's rights, the sheriff's office has to hire more people to process the applications of people WANTING TO FOLLOW THE LAW and get a PERMIT to carry a gun...and the only people you get to comment on this is an anti-gun group and the sheriff.

Biased much?

Anybody who thinks all gun owners are paranoid, and living in fear because of what they see on TV or the internet....think about where you're getting YOUR information from.

In 2013, the Center for Disease Control, after an Obama executive order, released a report on guns:

“Almost all national survey estimates indicate that defensive gun uses by victims are at least as common as offensive uses by criminals, with estimates of annual uses ranging from about 500,000 to more than 3 million per year…in the context of about 300,000 violent crimes involving firearms in 2008.”

Well regulated in fact means well trained. The information is easily available. Here are a few others…

"I ask, Sir, what is the militia? It is the whole people. To disarm the people is the best and most effectual way to enslave them."

George Mason

Co-author of the Second Amendment

The laws that forbid the carrying of arms are laws of such a nature. They disarm only those who are neither inclined nor determined to commit crimes.... Such laws make things worse for the assaulted and better for the assailants; they serve rather to encourage than to prevent homicides, for an unarmed man may be attacked with greater confidence than an armed man."

Thomas Jefferson

"Firearms stand next in importance to the constitution itself. They are the American people's liberty teeth and keystone under independence … from the hour the Pilgrims landed to the present day, events, occurrences and tendencies prove that to ensure peace security and happiness, the rifle and pistol are equally indispensable … the very atmosphere of firearms anywhere restrains evil interference — they deserve a place of honor with all that's good."

Moms Demand Action are traitors and their agenda is treasonous to the US Constitution.

1) People who are motivated by emotions: Are not rational and unfit to be making any decisions;
2) The testimonies of persons with invested personal interests: Are biased and incapable of logical debate;
3) Those who stand to profit: Are frauds and have no place in policy making.

Moms Demand Action are all 3 of those. This group has no scientific basis or ruling authority. They are simply an extremist group of angry women, trying to strip Americans of their civil liberties.

Typical liberal. Tell you a bold face lie straight to your face and expect it to go unchallenged. Only 11 states and the District of Columbia have a HIGHER rate of Gun Murders then California. Every other state is lower. http://en.wikipedia.org/wiki/Gun_violence_in_the_United_States_by_state

Amen to the 9th Circuit - leaving our second ammendment rights to the discretion of the county sheriff is riddiculous and unconstitutional (whether it be my opinion, or that of the judges).  I'll be applying for a permit - yes, sir.  The only thing accomplished by gun control laws is deterring law abiding citizens.  Next is time to get rid of the 10 round magazine rule and remove the assault rifle bans.

The 2nd amendment was originally added for the sole purpose of maintaining a militia. It wasn't until 2008 that the Supreme Court changed that definition to expand the right to bear arms to the entire population, however, still maintained that the right is not unlimited and is still subject to regulation.

If you're upset about the constitutionally granted right of the government to regulate the 2nd amendment (along with all other amendments), might I suggest moving to Somalia?

Actually, Chicago only ranks 43rd in gun violence. There are plenty of other cities with much looser guns laws that have much more gun violence than Chicago. Go figure.

@roman_archer  England and Australia had low firearm related death rates BEFORE banning guns in 1997. England had a mass shooting, 12 dead, multiple more injured, in 2010, 13 years after banning guns. They had 2 mass shootings in the previous 30 years, when guns were still legal. Violent crime has also skyrocketed there. Canada's gun laws aren't that strict, and gun ownership is prevalent there. That points to cultural factors in their low rate of homicide with a firearm. Japanese nationals who immigrate to the U.S. have rates of homicide with a firearm on par with their brethren back in Japan, even though they have access to guns here in America. Again, cultural differences.

Beverly Hills and Compton have the same gun laws, but wildly different rates of gun crime. Why do the laws that work in Beverly Hills not work in Compton? Or is it not the laws that are making the difference?

WE ARE THE MILITA

since you are so up on the Founding Fathers

THINK!!

THEY KNEW THE POWER OF THE / A GOVERNMENT and it having the only weapons

THEY KNEW that they are farmers etc had to form

"A MILITIA"

the definition may have changed over the years

BUT THE INTENT AND LOGIC ARE THE SAME

the government having that kind of UNCHECKED POWER IS THE

TRUE DANGER TO THE PEOPLE

radioburning
radioburning

And you think a militia is an organized army? The 2A is the only amendment in the Bill of Rights where "the right of the people..." means something other than the right of the people...

"I ask sir, what is the militia? It is the whole people except for a few politicians." - George Mason (father of the Bill of Rights and The Virginia Declaration of Rights)

"Arms in the hands of citizens may be used at individual discretion in private self defense." - John Adams

"No free man shall ever be debarred the use of arms." - Thomas Jefferson

radioburning
radioburning

You're misunderstanding what "well regulated" means, in the time and context of when the Bill of Rights was written. "Well regulated" does not mean "with regulations against what you can do or have". The entire purpose of the Bill of Rights was to define inalienable rights the government would have to have a very serious reasons to hinder. It was not designed to define limits to individual liberty.

"Well regulated" means "up to code" "well disciplined" "properly outfitted with working gear".

You flat out write the most bizarre, unitelligible posts I've seen from anyone that contributes to these blogs. And it's not due to your third grade level of writing that is laced with grammar, capitalization and punctuation errors. Nor is it due to your absolutely annoying habit of breaking every sentence up as if it were a seperate paragraph. It's the content. When I read your posts I always get this disturbing image of someone sitting at their computer inside their trailer home, typing away in their underwear while sipping away at their sixth Coors light of the afternoon with Fox news blaring away in the background.
