Robert Villa Killed by Tustin Police; Shooting Death Questioned by His Family

The family of a man shot to death by Tustin police officers Monday morning are questioning the use of lethal force and the way the mother of the deceased was informed of her 23-year-old son's death.

The end for Robert Villa came when the Tustin Police Department received an 11:35 a.m. call Monday about a family disturbance in the 1400 block of Nisson Road.

"When officers arrived, they were confronted with a male adult suspect armed with a knife," reads a statement from Tustin Police Sgt. Andrew Birozy. "An officer-involved shooting ensued and the suspect was struck."

The man was taken to Western Medical Center Santa Ana in critical condition, but he later died, said Birozy, who added the Orange County District Attorney's office is investigating the officer-involved shooting.

Birozy's statement does not identify the deceased, who actually had yet to be named by the department as this post went up. But Vicenta Hernandez, Robert Villa's cousin, confirms via Facebook he was the dead man.

"I live [in] Fontana and made my way to Orange County once I heard the devastating news that he had been shot four times in front of my aunt Leticia Villa," Hernandez writes. "My aunt was left without answers for hours until Western Medical staff advised her that my cousin Robert had passed."

Hernandez adds "it is my opinion" that the Tustin officers "should have took different actions to put my cousin down."

She wrote of Villa, "He had an unknown object in his hand, and I believe being shot four times in front of his mother is wrong in every single way. I want justice and want people to know my cousin wasn't a bad person; he was smart and very friendly ..."

Villa leaves behind a son, Hernandez added. His Facebook page indicates he worked at Freeway Honda in Santa Ana, attended Santiago High School in Corona Garden Grove and Santa Ana College and liked the Dallas Cowboys.

There are always two sides to every story. However, my experience with the TPD has not been very palatable. While they are here to protect and serve at the expense of our tax dollars, I dont feel we are getting what I pay for.


Weather there is more to the story or not, a family lost their son. A mother is grieving at a tragity that could of been handled with a taser instead of bullets. My heart goes out to Roberts family.

When someone dialled 911 due to some (wonderful, kind, loving, intelligent person, etc.) threating their life with a knife, a bat a gun etc.. Then police arrived if that loving intelligent, kind, woderful smart person doesn't comply with police's ordered, THAT PERSON IS A STUPID PERSON!!! He will be shot.


For the Villa's mother, sorry about your lost, But remember you called 911, you must take your own responsibility, don't blame someone else, blame yourself, he was your son, you did not teach him right at first....

my opinion on these cops is they used too much force on this, you have tasers for a reason! dont shoot unless youre getting shot at! that simple, you couldve just dissarmed him and went on with your days now you gotta live with a death on your hands. death of a friend a new father,son to a mother whose heart you all broke, ridiculous man. hope your family gets justice rob, RIP

Cops need to stop getting away with everything. They r dirty and I know people tht works at a hospital and tried to do a dirty shit just to put someone innocent in jail. But my friend was smart enough and cought on to it.. Y cops always have to use a gun for the dumbest shit.

The family can sue for wrongful death, hopefully they will. Also, was it his own family that called the police in the first place? It does not say that in this article. I do believe that the police did use excessive force and that there are and were better ways to handle this situation. It is terrible that this happened at all, but especially in front of his family. He was an employed father handling life as it comes. It is sad that his life is over. Hopefully the family will be able to put him to peace with dignity. And that his son and the rest of his family get some justice from the Tustin Police Department for his death.

they shot him four times , so he wouldent survive , so he wouldent be able to sue the fucken pigs if he didnt have that knife on him . Cops ALWAYS say oh the suspect had an "unknown object" in his hand . its getting old already . They're either not being trained correctly or they really do swear that just because a judge wont take it as murder God is gunna excuse him from this just cause he had a badge -.-

Check out the Tustin police departments facebook page. A lot of the Tustin residents seem to think it was a good shooting and are praising the cops. Very sad to read. The residents are calling a complete stranger a psychopath who deserved to die. What's wrong with people?

they used extreme excessive force. I don't even think they know what exactly was in his hands.First article I read it was a gun he had, then they said they believed it to be a knife.  I agree that they should have shot him in the leg, or the arm to stop him, or tazer him, or something but to open fire and shoot him 4 times is uncalled for. I am friends with his mother and they did it right in front of her. She was in the hospital and they wouldn't tell her anything for hours, Something has to be done. I don't agree with rioting like they did in Anaheim, but somebody has to take responsibility for this. also, they need to help her in burying him. This death is on their hands.

my question is, with all the non-lethal weapons police have at their immediate disposal, why are they shooting lethal weapons at someone carrying a knife, regardless of whether he was told to put it down. Chances are, they were not in stabbing/slashing distance and not in immediate danger, why couldn't he have been tazed (as every officer has a tazer gun on their hip/leg), or shot with bean bag rounds from a shotgun. I know the police have a difficult job, and I appreciate what they do on a daily basis, but how many people have to be killed/beaten to death before some retraining happens?

At the end of the day, protocol was to instruct the subject holding the knife, or whatever object he was holding to drop it and back away so the officer can conduct his investigation in response to the 911 call. If the guy didn't follow the officers instruction to drop whatever he was holding then its already bad news for the guy as he is now looked at as a direct threat to the officer and those around him. I will agree that shooting him 4 times probably wasn't needed...I would of tried to subdue him using less lethal means...its sad. A mother is without her son, and a little kid is without a father now all because of some poor choices.....truly sucks.

So he had a knife in his hand because he was cooking?? He was a big enough threat to have his own family call in to 911. So either the cop was going to possibly be stabbed or he was going to be shot. Sad situation all around but it's not ok to assault anyone with a knife. There are consequences...period!

@elizabethblundo When police come out, police don't just draw their gun and shoot! They ordered the guy to drop whatever he had in his hands, the guy did not comply...So bad thing happened!

To the future 911 callers, deal with your problems first, unless you want your (loving, intelligent, smart, kind, etc.) son, daughter, father, mother friends etc. die (if not comply with the police)
