OC Sheriff's Deputy Pleads Guilty to Pepper-Spraying Teen's Pizza, Gets No Jail Time

Categories: Where you from?

On the same week that an Orange County jury freed the killers of Kelly Thomas, there was another reminder that law enforcement in Orange County can do anything they damn well please with little fear of getting punished.

Last Friday, OC sheriff's deputy Juan Tavera pleaded guilty to pepper-spraying a teenager's pizza during a 2012 traffic stop in Laguna Hills. The teen and his friends--who were charged with no crime--fell violently ill to the poisoning. You and I do that spiking, we get time in the pen. Talavera's punishment? 100 days of community service, and probation.

Um, what?!

The sad thing is that Tavera's sentence is, as far I remember, the harshest punishment ever inflicted on an Orange County law enforcement official for excessive force while on the job. How pathetic is THAT? Maybe OC DA Tony Rackauckas is a fan of a spicy pie, and let him walk? He IS half-Mexi, ya know...

Just more proof that O.C. is becoming a police State. Especially after my un-lawfull Detention in Fullerton over the weekend. How ever once again, this is swept under the rug!!!  a reminder of the USE of PEPPER SPRAY!!!!!

CAL. PEN. CODE § 12403.7 : California Code - Section 12403.7

The headline should read - OC sheriff's deputy gets off.

Juan Tavera - How is it that laws don't apply to you?

Of course he gets to keep his job. As the public you should know that there are two sets of rules. One for Union Thugs and one for you. If you don't belong to the Union Thugs you loose your job. If you pay into the Union you get certain protections. In this case, you get a slap on the hand, which will be reduced; and you get to keep your job.

I'm not being a smartass when I ask this question. How do I go about doing what you suggested?

and Cops wonder why everyone hates them. While I feel bad for the guy that was poisoned by that pig this message is for all the cops reading this post: When I was a 19-20 years old I worked at a pizza place, trust me...the cooks did a whole lot worse to your pizza. In fact every restaurant will add a little something special to the food of a pig in uniform. It's almost like an unspoken rule in the hospitality industry. Enjoy you scumbags.

23 years my friend of honest, dedicated to the community police work. Before that, ten years in the Marines Corps. Every profession has a black sheep in the family. Even the clergy. Stop being so self righteous and do something productive for your community instead of ranting and raving about things beyond your control. Go volunteer, mentor, or be a big brother instead being a hater.

Oh, you're a cop! That's what your problem is. You believe in the thin blue line and that law enforcement should serve lighter sentences when they break the law that they're supposed to uphold. You should be just as angry if not more angry than everyone else because guys like this make you look bad.

We will not find out. Under POBOR, all records and hearings are confidential, even to media. That was from a 2006 ruling, Copley Publishing v Superior Court. Though, I still haven't quite figured out how our state supremes came up with that ruling, since it's in direct violation of our state constitution, under 2004

And we will never know what will happen to this deputy's career, courtesy of POBOR (Police Officer's Bill of Rights). Unbelievable.

Oh please, like real criminals have never gotten away with shit. Concentrate on real crime and the perpetrators getting off lightly and stop your silly crusade against the few law enforcement morons that give the good ones a bad name.

I think POBRA/POBOR (shortened version - Police Officers Bill of Rights) is in dire need of revising so that "officers" (definitely not gentlemen!) who do things such as this (and worse) undergo the same scrutiny and legal action that a civilian would undergo in the same situation! Of course, I also wish police unions would think twice about funding legal defenses...

If the victim(s) of this pepper-spraying incurred medical expenses, I hope they file a claim/suit for those, as well as pain and suffering.
