Hans Kevin Arellano Killing by Santa Ana Cop and Family's Confrontation with Police on Video

A Los Angeles television station obtained cell phone video from a witness to a Santa Ana police officer fatally shooting homeless father of two Hans Kevin Arellano on Tuesday afternoon. It's difficult to make out the action, but you clearly hear the death shot and the cameraman repeating, "Why'd they shoot him ... why'd they shoot him."

Meanwhile, another witness captured Arellano family members confronting police.

Here is the video obtained by CBS Los Angeles:

The witness, who wished to remain anonymous, reportedly told the station's news crew that the 13-year veteran officer got out of her patrol car in front of Jugo's La Tropicana juice bar on South Harbor Boulevard and asked Arellano to get on the ground.

"The gentlemen didn't get on the ground, he was still inside the restaurant," the witness continued. "She asked again. The man then exited the restaurant, and as he was exiting the restaurant, he said, 'What are you gonna do, bitch?' About a second later, she shot him in the chest."

"Obviously this is the first time we've seen this," Cpl. Anthony Bertagna, the Santa Ana Police Department spokesman, reportedly explained after being shown the footage by CBS2 reporter Michele Gile.

"This is something that is going to be a key piece of evidence. It's something that we encourage people, if they have, to bring forward. This needs to get in the hands of the D.A. and our detectives. Like the chief said [Wednesday], we're trying to be open and honest. There's three separate investigations that are going on simultaneously. This portion, as the chief said, I can't comment on."

Gile also showed the video to Arellano's relatives, who were reported to be "horrified" by what they saw. They believe the cop should not have used lethal force on the man who has become the fifth person shot dead by Santa Ana Police this year.

"I believe they should have Tased him, hit him with a baton, anything, but not shot him to kill him," Arellano's niece, Yenniffer Moreno, reportedly told Gile.

Family members are seen in video a different witness shot immediately after Tuesday's incident, emotionally seeking answers from Bertagna and other Santa Ana cops.

@18usc241Officer handled herself well considering the atitude of the person she was dealing with.  In my years as a Field Officer, that guy would have been out of the car and assuming the position in a blink of an eye. They would have been patted down, run for wants and warrants and have explained what they were doing in the parking lot.  I would have checked for  vehicle burglaries.  I would have walked around the vehicle, making an open view observation allowing cause to search the vheicle.  Yep, I would have followed the letter of the law.  While I know this is hard for a wantabe to grasp, what was just described is nothing but basic field police work.  Officers do it multiple times a day.  Sometime, people check ok, are thanked for their cooperation and sent on their way.  Other times, the suspect has just committed a crime, an arrest is made and stolen property recovered.

This is no cuddly out-of--shape homeless man. This is a wanted criminal who was detected at a public place. He's ordered to get down, twice, at gunpoint. Instead he shows aggression and gets shot.

Looks like standard procedure to me, and plenty of witnesses to his non-compliance. Just because someone filmed it and called him "gentleman" doesn't change the facts. I do hope the officer has absolutely no repercussions for this. She was protecting herself.

Good job SAPD. Keep up the good work with dealing with these scum bags. Kevin seems to be a hostile a-hole and was not a good guy. If family believes so, their clueless. If the family truly loved him he wouldn't be homeless. I wouldn't let a member of my family be so. It's very obvious they all of a sudden care about him because they want to be paid.

So let's take a closer look at the actual video and factual information:

The report says the man is a convicted burglar also wanted in a recent robbery.  Police are already on the lookout for this guy.

(2) In the actual report it was said the police officer was called as backup **after criminal activity was reported on the scene**.

(3) The person started recording before police backup arrived, he and his friend saying "… he’s crazy .. he (the shooting victim) was an IDIOT, (bro?)" for whatever he was doing as they started to film... So they are admitting he was up to no good.

(4) As police officer arrived, the man ran into a juice bar (1:03 in the video) (ran from cops? Sure you're showing them how innocent you are).   The eyewitness ignored this fact and said nothing about him running from the police.  More suspicious reporting of the witness.


(5)The police officer ran in after him. As they came out immediately after, that's when you hear the man **scream** "WHAT ARE YOU GOING TO DO, ... ?", not calmly saying it like the videotaping "witness" later claimed.

Contempt of cop sure seems to be a serious crime these days.  And if you want female police officers don't expect them to physically tangle with people they feel threatened by.  Alone, isn't their only real response to taze or shoot the guy?  I mean, we don't really believe women are just as strong as men do we?  And don't expect cops to put the public's safety before their own.  That's not really how it works these days is it?  And do we really believe this guy who's comment seems to suggest they like people filming cops?  I'm pretty sure there's stories all over the news all over the nation of cops going after people taping them.  Gee, I wonder why?

@PitterPatter Ok, so we don't like ass holes like this shooting off their big mouths at us or anyone else.  That said, verbal taunts and threats do not come close to rising to the level of a threat to a Police Officer. On the other hand, it is part of the territory when you pin on a badge?  If we eliminated all people in the country who are of such a mind, the population would be reduced by a third.  The bottom line with this case is for the investigation by the District Attorney to gather all the facts, evidence, witness accounts and then determine exactly what happened.  Only, then will we know if the use of deadly force was justified.

(6) The witness calls the homeless man a "gentleman", exposing his bias in trying to report the facts  - in the video he calls him crazy and an idiot – now he’s a “gentleman”.  Most would say "the man/guy ran in when police arrived.. and the man screamed "WHAT ARE YOU GOING TO DO.." - instead this is what the “witness” says "She asks the gentleman to get on the ground.  The gentleman, he didn’t .. he didn’t get on the ground.  He was still inside the restaurant [notice he doesn’t report that he ran away from cops into that restaurant].  She asked again and then man then approached, uh, exited the restaurant [didn’t mean to admit he approached the police officer screaming?], and as he was exiting the restaurant he said [no, he SCREAMED]  ‘what are you gonna do, ….?’ And about a second later, uhhhh, she shot him in the chest” [you can’t see him get shot in the video – no way to know it was specifically in the chest, unless it was clear he came at the police officer. More suspicious reporting from the “witness”]

So notice how he slips and says he approached the officer, then quickly backtracked and made it seem like he merely exited the restaurant nice and obedient. This after running FROM the police in the first place, approaching the police officer, as proven by being shot in the chest, not in the side or the back.

@ocjusticewarrior Rather than waste your time at City Hall, why don't you take your happy band of whiners and complainers down to the barrio in Santa Ana and protest the victimization of people by gangs and criminal elements.  The Cops could all stay away to assure you full freedom of speech and protest?  On the other hand, the gangs might not be as receptive to your protest as ae the Police and kick your collective asses.

As you might suspect, I don't really give a damn about you or your opinion. Police brutality exists -- I know, because two of my brothers were once cops. Criminal brutality also exists, and it is *MUCH* more prevalent. More dead criminals == less criminal brutality. I like that equation. And I won't even go into the whole "inhuman" part -- I've seen the evil that "humans" can do, with my own eyes. All over the world. Evil people exist, and they should be exterminated, period.

(7) At the moment of being shot you can’t see the police officer or the man (they are in the shadows being blocked by another pedestrian standing in the shadows), but you hear the gunshot.  The “witness” says in his report “then she shot him in the chest” – no way he even would know she shot him in the chest except after the fact OR unless he saw the man going at the police officer as he originally started to say then changed what he said.  Again more making up what he ‘witnessed’.

(8) The guy recording 40 yards away, easy, recording from the side, not the front and all the action was in the shadows, hard to make out. You couldn't hear a thing going on except that someone was yelling without being able to tell what they said, then you hear the man scream “WHAT YOU GONNA DO…. ?” (same thing you often hear at the start of a fight when someone approaches you, it should be noted..)

(9) Since the man was actually shot in the chest, this proves he was in fact facing the police officer, which corroborated with the witness slipping and saying “as he approached..” before quickly changing it to “as he exited..”

@Reason @Reason I used to work with my brothers and sometimes we'd get into situations with customers that were confrontational but never violent. Later we'd all give accounts to each other of the incident. Three witnesses and three very different renderings of exactly what happened.  Seems that just the different physical location of the other people gives a whole different viewpoint as to what the other says occurred

Sounds to me like we don't know what really happened - that the guy could easily have made a threatening move against the police officer (a big man against a female police officer, which seems more likely she would shoot rather than risk a melee with her gun already out that the guy could easily take from her if she didn’t stop him.)

I wouldn't be too quick to assume this was all calm, nothing going on, man calmly stated the "what are you going to do..." and the cop just gets mad and shoots him, which is what most commentators are implying in spite of all of the above.
