BREAKING: Supreme Court Clears Way for Gay Marriage to Resume in California, Rules DOMA Unconstitutional; 6:30 P.M. OC Rally TODAY

The U.S. Supreme Court this morning dismissed California's Prop 8 case, clearing the way for gay marriage to resume. On a historic day for marriage equality, the Supremes earlier announced the federal Defense of Marriage Act (DOMA), which does not recognize gay marriages, is unconstitutional.

"Today, the voices of our community and our allies have been heard and justice has prevailed," says Rodney Scott, president of Christopher Street West that produces annual LA PRIDE events.

"We celebrate the fact that marriage in California will soon again be an institution for all loving couples who are looking to join into a committed and loving relationship recognized by the state and protected by the law," Scott continues. "This has been a long and emotional fight, one based on basic human rights and one based on love. This is not, nor has it ever been about special treatment for the LGBT community but about basic human rights. This is truly a day of celebration and while we should embrace this triumphant win, we celebrate knowing that there are still battles ahead in the fight for true equality."

No matter how the rulings went, a coalition of OC LGBT groups and their allies planned to gather at the Old Orange County Courthouse at 6:30 p.m. today for a rally.

"We will gather [this] evening in Santa Ana to, we hope, celebrate, but more than anything, to come together as a community in times of great accomplishment or strife," read the press release from the Orange County Equality Coalition. "Let's show Orange County, California, and this country that we are here."

Chief Justice John Roberts read the 5-4 opinion that found Prop 8 backers did not have the legal right to challenge the lower court reversal of the voter initiative because the original case was directed not at them but California's governor and attorney general. Those state officials chose against mounting defenses of Prop 8, which defined marriage as being between one man and one woman.

This was the outcome UC Irvine School of Law Dean Erwin Chemerinsky predicted back in 2010.

The legal merits of Prop 8, the 2008 anti-gay marriage initiative funded by a hell of a lot OC rich guys and pushed from the pulpits by virtually every Christian denomination in OC save for the cool ones ... wasn't decided on with today's opinion. That means another federal judge's ruling overturning the referendum stands, meaning gay marriage is legal in California.

In the 5-4 DOMA ruling, the brief said "DOMA singles out a class of persons deemed by a State entitled to recognition and protection to enhance their own liberty."

Despite the court's ruling, you know this issue ain't going to go anywhere soon. More--much more--to come throughout the day...

Some guy people have more decent marriage lives than "regular" married people. We do estate planning for guy couples and "regular" couples and I have seen both. I don't see any difference between them. Besides, legally, domestic partnership has almost the same rights as marriage, so just one step up, it seems to me.

You're right, Steve. However, if they would have ruled Prop 8 unconstitutional, instead leaving it at a previous courts decision, it would have paved the way for gay marriage to be legalized all across the land. At least, that's my understanding of it; granted I'm not a lawyer, but the point still stands that progress in the United States seems to be extremely hard to come by and when it is, it's baby steps. We used to do big things. We see other countries doing big things. They're all going to leave us behind.

Jeff: I don't believe the Supremes have the power to "legalize" anything. They can only affirm or strike down what's already on the books. Re Roe v. Wade for instance, I don't believe it "legalized" abortion so much as that it invalidated the laws in various states outlawing abortion.

Interesting factoid: while the ruling against DOMA went along partisan lines (the four conservative justices ruled for keeping it, the other five moderate-to-liberal justices prevailed), the ruling about whether Prop 8 complainants had standing completely criss-crossed them.

I think I'll stick to my embattled Roman Catholic Religion which is in no way obligated to conduct "same sex" marriage. =D Other than that.... I think that's gay.

Attention! All straight married couples are now being directed to seek immediate divorce. You have 72 hours to divorce and marry a same-sex parnter. Failure to do so will result in forcable separation and random pairing by the IRS Obamacare Enforcement Kommisar!

constituting gay marriage doesn't mean every one is obligated to marry the same sex! It is just for group of people who think it is their right. No need to panic if you're against, you won't be affected.

Next up -- polygamy. After all, what's so special about the number two? And doesn't limiting 'marriage' to couples violate the rights of bisexuals (who are, btw, actually more numerous than homosexuals) who could easily find love in groups of three or more.

Why would your parents need u to fear them? (I.e. "my dads gonna kick my ass if he finds out I took his car without his permission). You fear God For your own good, thats what for:). God is our maker and the maker of this world. All sin is sin, this is why God sent Jesus to die for our sins, if we believe in His word, we get to enter heaven when we die. Most of us know about this but choose to ignore it cuz we would rather live life fully enjoying our sins. I love Jesus with all my heart but it doesn't change the fact that I'm a sinner, it just gives me hope that when I die, I will live eternally in heaven. I don't think that's beyond anyone's understanding.

Why would an all loving god need you to fear him. Is he that insecure?

God loves us all! He loves the sinners but not our sins. Some are gay, some are straight but we are ALL F'd up in the head one way or another.

From the Washington Post..... But the court said it violated equal protection to provide benefits to heterosexual couples while denying them to gay couples in the 12 states and the District of Columbia where same-sex couples can marry.... Remember this is for the 12 states that allow same-sex marriages

Does no one fear God anymore? May God forgive us all!

It's been baby steps for a long time now. Sucks, but the current makeup of our government precludes any other option.

Not when it comes to human rights. That's insane.

I think people better run out and get married quick before someone tries to overturn this

I think it's kind of a half assed ruling to not just legalize gay marriage across the whole country, but hey, apparently any progress has to be made in frustrating incremental steps.

Yay for DOMA being struck down. Too bad they didn't have the balls to strike down Prop 8 too

@Jake Westenberg But when you die, if you don't change beforehand, you'll fear His very real Enemy.

Your god is all about forgiveness, right? Just ask forgiveness for your bigotry against gays and I'm sure he will let you into the eternal country club or whatever.
