In Echoes of Todd Akin, OC Judge Admonished For "Technical Rape" Comments by Judicial Board After OC Weekly Report

One of my Moxley Confidential columns resulted this week in a unanimous decision by the California Commission on Judicial Ethics to publicly admonish Orange County Superior Court Judge Derek Johnson for opining that if a victim's vagina hadn't been "shredded" during a sexual assault then the woman gave at least partial consent to her attacker.

I covered the 2008 case of Metin Reza Gurel in Newport Beach and reported that Johnson, a former sex-crimes prosecutor, callously downplayed the defendant's conduct as "a technical rape" even though he repeatedly raped an ex-girlfriend, threatened to maim her face and vagina with a heated screwdriver, told her he was going to burn her to death, ordered forced fellatio and ejaculated in her mouth. 

When questioned by police after the crime, Gurel, then a 43-year-old native of Turkey, said that he was allowed in his culture to "scare" women into obedience.

Orange County prosecutors sought a term of 16 years in prison, but Johnson ridiculed the government for calling Gurel's conduct a rape. 

"I think it trivializes rape," said Johnson, who reduced the punishment to six years and deducted the sentence by 251 days in pre-conviction detention credit.

In Johnson's mind, the victim's vagina would have been "shredded" if it had been an actual rape.

"If someone doesn't want to have sexual intercourse, the body shuts down," the judge said. "The body will not permit that to happen unless a lot of damage is inflicted and we heard nothing about that in this case. That tells me that the victim in this case, although she wasn't necessarily willing, didn't put up a fight."

My comment at time: "That statement is so outrageous it's reminiscent of the cockamamie theories offered by defense lawyers during the sensational trial for the 2002 Haidl Gang Rape."

In that case, defense lawyers incredibly argued that if a rapist's penis entered a victim's rectum, that equals oral consent for the sex because otherwise a woman's body would not allow penetration. Those rapists lost that argument and went to prison.

In the Gurel case, the state judicial board stated that Johnson's "remarks reflected outdated, biased and insensitive views about sexual assault victims who do not 'put up a fight.'"

And they added, "Such comments cannot help but diminish public confidence and trust in the impartiality of the judiciary."

Johnson apologized to the commission.

Wow it shocks me to hear somethang like this came from someone who is supposed to be helping keep our streets safe from the sickos who cause this type of pain and hurt on women. Maybe he should go live over in the middle east where they are acustomed to this behavior to women .... Because here in America we belive when a woman who is in a realationship if she says no... THAT IS WHAT IT MEANS........

Very, very recently, I was a juror on a criminal case presided over by Hon. Judge Johnson.  His conduct throughout those 3 days was the epitome of professionalism and integrity.  I can't believe the same person said what was transcribed back in '08.  Everyone -- everyone -- sometimes says things that are inappropriate and that they don't really mean.  I'm hoping that's true here, and this was just an aberration.


Credit where it's due, Scott, and you deserve serious credit for this one.

A net search (so far unsuccessful) to prove/disprove those ignorantly throwing slurs at Republicans for this guys idiocy, turned up the following - According to smart 2008, Election results, Johnson was ONE OF 30 O.C. Judges assuming the bench, WITHOUT SO MUCH AS AN ELECTION, (Cripes! One of THIRTY!)being THE ONLY ONE to step forward and apply for the post! The voters cannot be blamed for a decision THEY NEVER GOT A CHANCE TO MAKE, but those of us still having a functioning sense of smell, can add Judicial Elections (Besides fallout from the Prop 14 'Top 2' Primary) for reasons CA SUCKS. It might be also interesting to note, this SAME 'Judge' claimed 'Festivus' (Yes, the Seinfeld 'Holiday') as grounds(AFTER drawing a blank and soliciting DEFENSE suggestions!) as religious grounds for granting a prisoners (extra cost) special dietary requests! See- it only LUCK that we have not heard similar things about the other 29, who merely STEPPED INTO OFFICE?I had previously asked Augusto Arellano about shining more light on our dysfuntional-to-the-extreme 'judicial' system, instead of the Octomom, etc.- - -NOW I'M SCREAMING!


A pity the commission couldn't sentence the ignorant jerk to a coupla weeks in general population at Pelican Bay. He'd likely acquire a different outlook on rape after a few, uh, Johnsons in his ass ...


More importantly, tell us when this man runs for re-election. PLEASE make sure he does not run unopposed and throw him off the bench.
