Mom and Son Sue Kaiser and CHOC for "Botched" Delivery Where His Twin Died

An infant who survived his delivery with brain damage but whose twin died is suing Kaiser Permanente and Children's Hospital of Orange County (CHOC) for negligence and medical malpractice from "botched" prenatal, labor, delivery and post-natal care.

A dollar amount is not specified in the complaint filed in Orange County Superior Court.

The suit by the unnamed mother and son, who are represented by lawyer Marshall Silberberg of Irvine, claims Kaiser screwed up "the examinations, ultrasounds, evaluations, diagnosis, care and treatment" of them. The mother, whose deceased child died of complications from hypoxic ischemic encephalopathy,was not told of alternative treatment possibilities, according to the complaint.

The suit singles out 10 CHOC doctors for negligence.

While no exact dollar amount is sought, the damages would be hefty if a judge or jury shares the plaintiffs' view that they should be compensated for the boy's lost earning potential, physical and emotional pain and "past and future medical care, nursing care, attendant, rehabilitation, physical and occupational therapy, speech therapy, educational therapy and attendant expenses."
