[UPDATED: Ron Thomas Eases Tensions] Kelly's Army Fracturing Due to Questions of Money Raised and Ron Thomas

ORIGINAL POST, Sept. 21, 3 p.m.: After more than a year of police brutality protests that launched a successful city recall election and saw two Fullerton police officers charged with killing mentally ill homeless man Kelly Thomas, Kelly's Army--citizens who banded together to insure justice--has fractured.

Members of the activist group and an organizer of a recent art show held to raise money for the Kelly Thomas Memorial Fund (KTMF) say questions over how donations are being spent have driven a wedge between Ron Thomas, the victim's father, and the group. 

Stephan Baxter, who organized the Art with an Agenda show at the Pas Gallery in July said the conflict reached a boiling point yesterday after Thomas refused to honor a verbal agreement the two had regarding the disbursement of donations from the event, which totaled $10,200.

"I wanted to get a promise from him prior to turning the money over," said Baxter, who asked Thomas to sign a contract promising to donate a portion of the money within 30 days to local homelessness charities. Thomas refused to sign, according to Baxter who turned the money over to the foundation anyway.

(The foundation began in 2011 with the stated mission of dedicating assistance to homeless men, women and children of Orange County and is run by Mr. Thomas.)

"I thought it would appease his detractors if we had $5,200 donated right away," said Baxter. "Out of the money that came from the art show, he gave $2,000 to First Christian (Church of Fullerton)."

Baxter maintains the rest of the money would go to a charitable organization called Pathways of Hope.

"As it turns out," said Baxter. "It hasn't."

Speaking to the Weekly, Thomas said that he has been working with acting Fullerton police chief Dan Hughes and Pathways of Hope to construct shower facilities and lockers for local homeless people.

"I'm still working on that," said Thomas. "(Baxter) wanted me to spend the money already but I'm still in meetings with directors of these [Pathways]."

But Baxter isn't the only one who has expressed frustration with Thomas and the donations. Marlena Carrillo, a Fullerton resident who has been active in Kelly's Army since its inception and has worked for the KTMF, said concerns about the handling of the money have been bandied about for some time now.

"I started trying to figure how much KTMF has made, and we could never get a straight answer (from Thomas)," said Carrillo. "I kept asking him. That's why me and Ron had a falling out."

Carrillo added that Thomas blocked her and other members of Kelly's Army on Facebook and from the KTMF website.

The group was scheduled to meet in early August following the art show to account for the money collected. Carrillo says that unknown to many, Thomas had canceled the meeting, and several showed up any way.

"We were at the point where we had been working our asses off," said Carrillo. "We were supposed to be part of this board. When we called Ron to ask him about it, he just flipped, 'You hijacked my meeting.'"

But Thomas maintained there is no board and he alone is responsible for the foundation.

"These are people who are demanding that I bow to their every whim and demand, and I'm not going to do it," said Thomas. "I just don't see any reason for me to relinquish control of the foundation I started. They sit on the sidelines and badger me from their arm chairs until I do what they want."

Carrillo says this is a slap in the face.

"We protest in front of Fullerton police department every Saturday, this is what we do," she said. "For Ron Thomas to trash us when all we want to know where the money is frustrating. I don't want any more people getting suckered into KTMF when it's not being handled right."

Despite the bad blood, all parties say they will continue to seek justice for Kelly. Carrillo and others continue to protest in front of the police station on Saturdays demanding charges against a third officer, Joe Wolfe as well as the firing of the three other officers involved in the beating. This week, Thomas appeared at the city council as Hughes cleared his son of breaking into cars before officers beat him to death. 

In an email, a frustrated Baxter expressed sympathy for the many directions Thomas is being pulled.

"I knew Kelly (and) so did many others," wrote Baxter. "But it was Ron who Kelly turned to when he was being murdered. I don't forget that."

UPDATE, Sept, 22: The Weekly just received a call from Baxter, organizer of the Art With an Agenda. He said Garo Mardirossian, the attorney for Ron Thomas, just handed him a $3,120 check for Pathways of Hope. Baxter said the money will benefit homeless individuals in Fullerton.

"It means (Ron has) met his obligations," said Baxter, added that Mardirossian told him additional funds will be donated by his client.

Tensions arose between Baxter and Thomas over how the money raised by the art show would be spent. Baxter maintained that in promoting the show, he promised a certain portion would go to Fullerton charities. He attempted to get Thomas to sign a letter of agreement that the money would be donated within a specific time frame. 

Thomas, who refused to sign the agreement, told the Weekly yesterday he was working with city officials and Pathways of Hope to construct showers and lockers for Fullerton homeless, but that the process was still in the planning stages. 

Baxter said that despite the bad blood wrought by his disagreement with Thomas, he's still intent on seeing charges brought against former Fullerton Officer Joe Wolfe for his participation in the killing.

"If that means I need to occasionally be in contact with Ron, then so be it," said Baxter. "I'm trying hard not to judge him, he's a grieving father. I just know I made certain promises."

Do oversight. Have an attorney arbitrate, or choose a neutral 3rd party. Thomas should NOT be in control of the money. He is too stressed out about the legal issues surrounding his son. He already has too much on his plate. Ease him out. Refocus him on the trial and getting the third cop charged, THESE are his priorities. Also, until this is over, you need to channel this money to Thomas' attorney. You can't beat the devil without it. Give it to the atty, ALL of it. Thomas already has a plan to use a damages award to care for the homeless. That will come later. In the meanwhile, raise funds for and Resource the trial. STAY FOCUSED.

this is CRAZY!!! Kelly's army comes from all walks of life and that's why i love us!!! each and every single one of us worked our ass's off for Justice for Kelly! I am surprised and saddened by all the name calling in the comments section. Many people, including those mentioned have done a tremendous job working for justice for Kelly and making sure Kelly's story doesn't die with him. Change has happened in Fullerton and there are many people helped, far more than I ever did. I am thankful for Christine, Shelly, Dana, Marlena, Renee, Bax, Ryan, Tony and others I am sure I am missing who stood on the front lines when it wasn't popular. I for one, am grateful for those people who literally watched over the city with so much passion and dedication this past year. J4K

Maybe we can talk about Officer Joe Wolfe, who struck Kelly first and is uncharged at all? Or, we could talk about Kenton Hampton, James Blatney, and Kevin Craig and the fact that after killing Kelly Thomas they are back  to work, or we could talk about the OCDA who is not charging obvious criminals with their crimes. We are all Kelly Thomas, and more than half of his murderers are WALKING scott free! This cannot stand. People these cops may kill someone you love in the future. STAND UP and say NO, it is within your power, when it effects you personally it is far too late!

Some of you would be more comfortable over at the Register. Their readers are more troll like than the OC Weekly. I don't like the sexist insults that are being waged at Marlena on here. If you care to disagree with opinion that's one thing, but Marlena is not a public figure. You clearly do not know her, or how she conducts herself. I worked with her leading up to the art exhibit and she was a tireless volunteer and without her help things would not have gone as well as they did. Her kids were often with her, all happy, all well adjusted, and all very proud of their mother. Other days she was unable to help, because she was at their games or other function (i.e. being a good parent). 

 

I'm not above criticizing the action of some people with whom I disagree, but I feel in order for anyone to take my criticism seriously, that I must post under my real name. If you are critical, especially if you are slinging some heavy mud, I suggest you do so under your real identity. That way the reader can weigh your comments against who you are, know if you have any credibility built up in the community, and judge if you have some hidden agenda. Calling names in general is pointless, even more so when done from the protection of a fake moniker. Marlena stood in front of cops with guns and told them to stand down preventing a riot, it's documented. While those that are attacking her don't even have the stones to do so as themselves. Your post, and your opinions consequently amount to little more than a semi colon in the pages of this movement. You yourself amount to little more than a colon. (See, it's ok for me to call you a colon, I'm doing so as in the light of my own name) 

 

Move on. Ron lived up to his obligations, the money has now been paid, and local homeless will soon benefit from it. We have more important things to accomplish than to worry about who is, or is not, smoking ... (and I'll use a term you are comfortable with)  "Mary Jane".

Mr. Baxter - you say Ron Thomas was a member of OCSD. For how long was this? My understanding was that it was only for a few weeks before he left the academy. Is that your understanding?  If this is true, Ron is a disgraceful for pretending to be a real veteran retired cop, all to feed his ego in the spotlight.  Yes, Kelly was calling for his dad while he was dying. But I'll bet he was calling him years and years - all with no response. Having a mentally ill son is unimaginable. But his mom gets credit for keeping in contact with him for years, and even sharing an apartment with him just a few years before his death.  The media should be ashamed at letting Ron Thomas continue this sharade

I also have many concerns about why Kelly Thomas was taken to St. Jude's first, when all medical personnel knew how seriously injured he was.  And why would St. Jude's send him away, if it did... one would think a critically injured patient would be transported as little as possible.  Kelly was transferred from the Fullerton Transportion site by paramedics, to St. Jude's to Western Medical, where John Derek Chamberlain also died.  Hopefully, photographs and medical records of both Kelly Thomas and John Derek Chamberlain were not confused in any way, shape or form, since it is most likely neither had health insurance and the County of Orange picked up the medical bills for both deaths.  TOO MANY UNANSWERED QUESTIONS!

One of the concerns I have involves the quick payment of $1 million to Kelly Thomas' father, payment for loss of her son, Kelly Thomas, which excludes Ron Thomas, as Kelly's father.  What entity paid the $1 million, the Fullerton Transportation's premise liability insurer, the City of Fullerton's premise liability insurer, the Fullerton Police Department, the County of Orange, and/or one of those shared malpractice insurance carriers that is never held accountable to the public?

 

According to the OC Board of Supervisors, John Derek Chamberlain's father received somewhere around $500,000 to $2.5 million, depending of course, on reports to date.  It would be interesting to find out what entity paid this insurance payout... County of Orange, OC Sheriff, and whether it relates to premise liability insurance or neglience issues. 

 

In my opinion, someone and/or something wanted to rid the tragic death of Kelly Thomas from his mother's supervision... so of course, in the rich and famous Orange County, California, money and a large insurance payout buys silence and justice, if $1 million is even worth the life of a child.

 

Too many questions are still unanswered.... and we can only pray that Kelly Thomas' death will not be exploited by corrupt individuals who have a duty to protect the public from abuses of the US court system and taxpayer funds.

I'm glad this is finally getting some attention. There are several questions that come to mind about Ron Thomas that the press has never bothered to pursue.  In addition to the questions about the KTMF donations, I think it's long overdue for a journalist to clarify the following:

 

Is he genetically related to Kelly?  If not, then followup questions should be asked about his parental involvement in Kelly's life.  Have they ever lived together under the same roof?  For how long?  Did he ever support Kelly financially?  What about his divorce from the mother....is anything mentioned about support or custody for Kelly?  What sort of efforts were made by Ron, say, within the last five years, to support Kelly and get him on the right track?

 

When the story broke, Ron made comments indicating he was an expert in police tactics, given that he was a former deputy and tactics instructor.  How long did he work for OCSD?  When?  Why did he stop working there?  Did he resign, or was he terminated?  If he resigned, was it it lieu of termination?  If so, why was he going to be terminated?  When did he instruct police officers, and under what circumstances?  What qualifies him to be a tactics instructor?  He's also made comments that he has instructed the military, and I'd like to see some clarification there as well.

 

What does he do for work?  I believe his electrician's license (#680207) expired in 2005.  The name on the license is Frederick Ronald Thomas Jr.  He's made statements indicating he continues to work as an electrician.  Is he working as an unlicensed contractor?

 

Don't confuse my raising these questions with how I feel about the Kelly Thomas case.  Thomas should not have died that night and it was the fault of FPD.  Nonetheless, I've been amazed at the reluctance of journalists to question anything at all about Ron Thomas and his credibility.

1. This is Stephan Baxter. I have been promised a check from KTMF in the amount of $3,120 by 5pm today. I will call Brandon to confirm the minute it's in my hand. The check with be written out directly to Pathways of Hope. POH has in turn promised to spend all of it locally on the hungry, the homeless and those in transition from being homeless. They are a great organization. This will be in addition to the 2k already turned over to the 1st Christian Church in Fullerton which feeds the homeless once a week and sometimes has a line of hungry 1/2 a city block. To those that are jumping on KTMF over the delay in money being distributed (which includes me) I say: When is the last time you ever handed over $5,000 to help people you have never met? Please speak up, we are all dying to know.

 

2. Were it not for people like Marlena who volunteered for the art show, and who have been vocal since the beginning, there would be no money do distribute and there would be no justice. Google the Anaheim protest and you will find a video of Marlena and couple others standing between armed cops, some on horses, and mask wearing anarchists holding clubs. They got between them and literally prevented a riot. They put their bodies on the line to keep the peace. Marlena received a voice mail from a captain at APD thanking her and her friends for their actions, I for one have never done anything that brave and have mad respect for those that keep peace at great personal risk like she did. To her detractors I ask: When is the last time you risk injury and arrest to keep the peace? Please speak up, we are all dying to know. 

 

3. Any faults Ron may have and any disagreements I may have with him, come from him being a cop at one time in his life. Cop tactics do not always go over well. I assure you he was a member of Sheriffs dept. To his detractors, and sometimes I am one of them, I say, can you be assured that our child would cry out for you in the last moments of their life? Please speak up, we are all dying to know. 

 

The Justice 4 Kelly movement has made some mistakes, so have I, but to those that celebrate our failings, but have never once shown any support, I say ... we have moved the goal posts further in this case, legally, politically, and socially more so than any police brutality case in U.S. history. If one of these three thugs is convicted it will be the first time ANY on duty officer in California history will have every been convicted of murder. That means that since our State's founding in 1850, according to the law, every single encounter with any peace officer in 162 years which ended in the death of suspect or a witnessed has been found to be justified. You, even the cops among you, know that is pure bullshit.  To our detractors I say, when is the last time you made history? Please speak up, we are all dying to know.

 

This fight is not over. Wolfe needs to be charged for his involvement in Kelly's murder, Hampton, Craig and Blatney need to be fired, and the homeless and mentally ill need our help. If you are sick of hearing about this case and you are tired of us making noise, join us, help us, be part of justice. if you do that with us we will get there sooner and we can move on to spending more time with families, our friends and on other causes which need our help. 

 

To the OC Weekly I say, thanks for your continued interest in this story. We are fortunate to have you looking out for the people.

Next article should cover the real length of time Ron Thomas was a police officer, and whether Ron has falsified an image of himself some ex-cop with many years of service under his belt.

 @CRIMECONCERNS Your first sentence has a serious error.  The quick payment of $1 million was made to Kelly Thomas' MOTHER!  She had a different lawyer than Ron Thomas and chose to make a quick settlement.  The payment was made by the City of Fullerton and city council approved the payment.  Hope that helps clear up misconceptions.

As a group, you are victimizing the victim in all of this- and it's over money and attention. That's pretty sad, and pretty disgusting. @PazYCarnetoo  The questions I raise are the business of every taxpayer in Fullerton (of which I am one), everyone who has donated to KTMF, everyone who attended the concert and bought a t-shirt or made a donation, the bands that played the concert, etc.

 

Don't misconstrue my raising of these questions with whether Ron and Cathy Thomas are victims.  These are separate and distinct issues.

 @prettydisgusted 43 artists worked pretty hard for those measly thousands, all of which will now be helping the homeless. How much have you raised? To someone sleeping rough it's more than measly, for whatever time it gets them into housing or food it's the difference between existence and living. I tried many other avenues before deciding on going public. Now it's been paid, and if trolls like you stop posting we can move on and focus on what is needed here and that is to hold those involved accountable.

Point is, there were plenty of people around, including the 80 some people while an innocent man was getting beaten to death. There were plenty of people witness to this tragedy before, during and after.

It's what you do from the heart, not for what you can get out of all this, that matters in the long run. This appears to be falling apart because some are in it, and their reasons are not altruistic. Unstandable, this has taken a lot of effort- but if people want to be paid for their time, then say it.

This is not directed at you, as your intentions appear honorable. There are some who are projecting on the wrong people. Look at the people being attacked! It's not the police officers who are getting the attacks! It's Ron, Marlena, etc. Pretty soon, it could turn on you as well, and what for??

 @baxter65 Yes, it's been paid, but at what price? Yes, you can move on, but the damage may be irreparable. From what's been reported, the lawyer had the funds, which were in the process of being channeled to where they'd be used. Maybe Ron held on too long to the money, but he didn't run off with it, did he?

Hopefully now you'll be able to gather the others to support Ron in the fight for justice. If things remain as splintered as they have, things will continue to dissolve into more pettiness and mud slinging.

When it involves hate such as Shelly spews on people for absolutely no reason, yes it matters. What goes around comes around! If you send evil out, it will eventually come knocking back at your door.  @jonnyowes Oh brother! I'm sure anyone who has a bad word to say about Marlena are alcoholics and pill poppers. Ron had his reasons for distancing her and the others out of KTMF and to say it was over the money is absolutely absurd! Ron has always been very clear when it comes to doing things in the name of Kelly. This was his son, the one who cried for his father all the while he was being murdered by 6 Fullerton cops. His last words were. "I LOVE YOU DAD!"

we live in the great state of California which is legal to take your own medicine if your license to do so. do you not take aspirin? probably along with your xanax and alcohol consumption. someone who is taking their free time and not getting paid because they do it out of the kindness of the heart for a Cause cannot take a break and take their medicine? and once again we live in a free country freedom of religion that should not matter to anybody.
