VIDEO: Huntington Beach Cops Beat Up Handcuffed Man

You can't really blame the Huntington Beach Police Department for being pissed off.

Lately, all the news about officer-involved shootings and police brutality has been coming out of Fullerton (the world-famous Kelly Thomas beating) and Anaheim (two officer involved shootings over the weekend). But the Surf City cops can rest easy now, thanks to a video that just surfaced showing their officers beating up on a handcuffed guy who apparently earned their wrath by flicking a cigarette in their general direction.

The incident took place in the wee hours of July 8, when 22-year-old Garden Grove resident Donald Costilow, Jr., was walking down Main Street after a night of drinking. According to a complaint he filed with the city, he attempted to flick his just-smoked cigarette into a trash bin, but it bounced off the receptacle and landed in the general area of a passing police cruiser. The next thing Costilow knew, according to his complaint, the cops had grabbed him from behind and pulled him to the ground.


Cellphone video taken by his girlfriend shows Costilow already restrained, lying on his stomach, with several officers around him, punches flying. "They just came up from behind me and grabbed my arms," Costilow told the Orange County Register, which posted the video this morning. "Eventually, one got me in a headlock and took me down. He kept saying, 'You're going to sleep. I was totally restrained while guy was punching me in the face...The guy totally lost control."

The police claim to be conducting an investigation into the incident, but meanwhile, a spokesman for the department defended the officers' actions to the Reg. "A marked police unit is going by, this young man flicks a cigarette disrepectfullly," the spokeman said. "Two officers go to talk to him and he just walks away . . . He was arrested because that incinerating device hit the ground."

When when when is this going to stop? Why does the general public and editors of news outlets like this one continue to treat every single OC Police Corruption file like a stand alone isolated incident? Lets sit back and add up each and every criminal case involving multiple police officers across OC municipalities.  How can we trust Police Officers and more importantly how can OC courts just take Officers at their word in criminal cases they bring before the courts?

 

There is a huge problem here and its got to be addressed.

Just be the IMPARTIAL journalists you are supposed to be and shine the light on ALL angles of the stories you cover and the corruption you (correctly) sense will stick out like a sore thumb. Andre Miller knows whats up. I have been an HB NB res my whole life and have had every kind of minor run in with the police. the drunk fool definitely added some lip and attitude to his ignorance ( most people who smoke in public walk ways nowadays are. fact) vid does no justice to details. just disrespectful obnoxious screaming and panic in attempt to catch injustice upon the little man.The dude didn't yield. "unfortunately" you are supposed to yield to authority even if it means acknowledging the smallest request to respond. - rookie mistake- takes time to learn it but you must humble yourself before the mighty hand of the, law,cops, po po, 50, pigs, oinks whatever.......

Ok - so I'm not proud of this, but here goes. I got in a fight (verbal) with my wife and walked to downtown HB to blow off some steam. I decided to have a couple of vodka drinks. I gave up drinking around 6 years ago, so I guess now I'm a lightweight + I had not eaten anything since breakfast. Fully buzzed, I walked home. I didn't make it. My wife was driving aroung looking for me 'cause I wasn't answering my phone. She found me hand cuffed to a telephone pole on the next corner over from our house. She asked one of the six cops standing around me what happened, turns out I passed out on the lawn on the house on the corner. They said that I looked like a local(prolly looked at my ID) and thought they would do me a favor and handcuff me to a pole (dis-lcating my left shoulder in the process) and wait for someone to claim me instead of throw me in the drunk tank. The cops told her I was funny and polite so they let me go with a "Don't say the HBPD never did you any favors". Half the people I tell this to say I'm lucky, half say I should sue for abuse of power. I'm inclined to think I'm lucky(but my shouder has never been the same), and I have renewed vigor for sobriety.

 

Anyone care to share thoughts/opinions?

I'm seconding what Andre Miller said above. HBPD working that area actually tend to be pretty chill for the most part and let a lot of things pass, so in the events leading up to the video, the "victim" had to have done something to provoke that level of response. And, I'm gonna admit my bias here, I'm not quite buying the story here as related by a drunk guy with a shrieking, hysterical girlfriend.

As an HB resident and one of very few black people who live in the city...I've noticed that alot of people who come down to Main St who aren't locals...they come to drink and have a good time & some have to be escorted out b/c they're having too much of a good time....I'm not advocating this dude (black, white or indifferent) getting his ass whipped but HBPD sees alot of BS and lets alot of things go...this dude had to have incited something....Just like locals know to have a light on your bike when riding at night...a smoker should know its illegal to flick a cigarette butt at a cop, I mean on the ground....One question though...where was the cigarette trash can in regards to the police vehicle, in the middle of the street?????

Let's hope this story is covered with the level of integrity that once covered the OC Weekly news room. The story of Joel Acevedo, as covered by Amber Stephens is an embarrassment to journalism. Even with the admittance that his mother is a friend of hers, the story reads as if an innocent man was slain by blood thirsty cops. OC Weekly, keep your news on point. Advocating for victims like Kelly Thomas is one thing, but advocating for a gang member who shot at police from a stolen car is another.

@Dorothy Ramirez to start with they have a DA who considers them to be like 007 their badge is a license to kill. unless there are 100 people with cell phones  photographing the brutality then turning the video over to honest media like OC Weekly or Voice of OC it will get white washed just like everything else. & trust me those 2 Fullerton Murderers will end up walking, why do you think the DA took the case personally? Thats why I sit around the house in my boxers and wifebeater and pound my keystones.  I cant disrespect cops that way... Just my wife and dog!

 Well John, If your read my comment, I consider myself lucky for what they did. I was just sharing my story to show that the HBPD works with the locals, even if it is in their own demented way.

As far as passing out on your lawn, sorry but that is the nature of passing out. I do regret tossing 6 years of sobriety out the window, but that is my own demon to strugle with.

After gving your blog posts a quck skim, I'm guessing that was a shot at your version of humor.

And thank you, being sober is the hardest thing I've ever done. I was really pissed at my wife and that was my first time "off the wagon". 6 years down the drain, gotta start counting all over again.
