[UPDATED with More Delegates Join Revolt:] Is a GOP Goon Squad Intimidating Ron Paul Delegates into Voting Romney at Convention?

See update at end of this post about 40 more national convention delegates seeking to join the 123 who have filed suit and "hundreds more" possibly ready to do the same.

ORIGINAL POST, JUNE 13, 12:39 P.M.: The Republican National Committee (RNC) is using violence, intimidation and ballot stuffing to deter 123 would-be convention delegates from voting for Ron Paul at the Aug. 27 convention in Tampa, Florida. So claims a civil rights lawsuit filed at the Ronald Reagan Courthouse in Santa Ana against the RNC, its chairman Reince Priebus and various state GOP chairmen. Among the complaints is uniformed GOP goon squads are hassling Paul delegates.

Brought by lawyers from Richard Gilbert & Marlowe, which represents the Texas congressman, the suit seeks to "unbound" Paul delegates "to vote their conscience free from any intimidation from any person or entity." The plaintiff delegates and defendant party chairmen come from states in the 9th Circuit federal court, which are Alaska, Arizona, California, Hawaii, Idaho, Montana, Nevada, Oregon and Washington. Downtown Santa Ana's Reagan building is a 9th Circuit courthouse.

The plaintiffs describe the suit in the following video:



"Plaintiffs come to Federal Court," states the complaint, "to seek the guidance of the court regarding the federal question as to whether plaintiffs are free to vote their conscience on the first and all ballots at the federal election known as the Republican National Convention, or whether plaintiffs are bound to vote for a particular candidate as instructed by defendants' state party bylaws, or state laws, or the preference of political operatives seeking affidavits of loyalty to a particular candidate under penalty of perjury."

The Paul delegates cite federal law that reads: "No person, whether acting under the color of law or otherwise, shall intimidate, threaten, coerce, or attempt to intimidate, threaten, or coerce any other person for the purpose of interfering with the right of such person to vote or to vote as he may choose, or of causing such other person to vote for, or not to vote for, any candidate for the office of president."

Republican Party bylaws also indicate delegates are free to vote for whichever candidate they want. Yet, according to the suit, Paul delegates have been harassed in nearly every state for failing to support Mitt Romney.

"This harassment included the use of violence, intimidating demands that delegates sign affidavits under penalty of perjury with the threat of criminal prosecution for perjury as well as financial penalties and fines if the delegate fails to vote as instructed by defendants rather than vote the delegate's conscience," states the complaint.

The Paul backers even claim RNC goon squads--in the form of thugs dressed in dark security guard clothing--have been employed to intimidate them.

And despite what you may have read, heard or seen from the media, the Paul delegates claim Romney does not yet have the GOP nomination sewn up.

"Governor Romney does not have 1,144 delegates, the minimum number of delegates required to win the nomination, and no candidate can be assured that they are the nominee until the delegates vote because the delegates have a statutory and constitutional right to vote their conscience," reads the complaint.

To get closer to their desired outcome, the GOP brass has "fixed" elections, "stuffed ballots" and "changed ballot results" to favor Romney, "including programming a voting machine in Arizona to count Ron Paul votes as Governor Romney votes," the complaint alleges.

It is further claimed delegates who do not sign loyalty affidavits to Romney "are told they may not serve as delegates, even though they were duly elected," claims the suit, which singles out Priebus for orchestrating the intimidation.
 
Besides allowing the delegates to vote for the candidate of their choice, the lawsuit seeks recounts of suspect ballots and the reinstatement of Paul delegates who lost their seats at the convention because they refused to sign loyalty affidavits. 

The RNC and Paul campaign, which previously advised its delegates to lay low before the convention, are so far maintaining stony silence on the complaint.

UPDATE, JUNE 15, 1:24 P.M.: At least 40 more Republican National Convention delegates are seeking to join the lawsuit filed by 123 others who claim they are being pressured to vote for Mitt Romney, and Ron Paul's lawyer claims hundreds of more delegates may want to do the same.

Richard Gilbert of Gilbert & Marlowe claims he has more than 100 signed affidavits from delegates claiming the GOP is rigging elections and committing voting fraud, and he accused "some campaigns" of acting "like organized crime syndicates."

It's not difficult to figure out whose campaign Gilbert is singling out.

"In Arizona, the voting machines were rigged so that Ron Paul votes were counted as Mitt Romney votes," he tells Courthouse News Service. "It was so intentional that a Romney delegate refused to certify the vote count, and for that he got thrown off the convention."

Party rules prevent changing rules within 30 days of a convention, but Gilbert claims chairmen and organizers often change rules the day before or even during a convention to deny quorums or rig outcomes.

Judge David O. Carter of Santa Ana's U.S. District Court is hearing the case, although no dates have been set. The Clinton appointee is used to dealing with presidential election issues, being the judge who drew the short straw to deal with various funny legal papers filed by Aliso Viejo's Orly Taitz, who claims Barack Obama was not born in the U.S.

Have you actually SEEN any of the videos taken of the fraudulent acts, and the police at the Nevada caucus?  I wouldn't call any of that "fair and square."  Why doesn't Romney have much of a turnout at any of his rallies if so many people are for him?  Why does Ron Paul have SO MANY enthusiastic ones?  And it's not a matter of attempting to "upset things just because we didn't get our way; it's called "a Constitutional right to choose our leaders" that's being taken from us by this organized crime syndicate.  If you'll wink at that and call it frivolous, you'll wink at anything.

Hello Organicduderanch---I expect you know about the  civil rights lawsuit filed on behalf of delegates.   If you do not, please go to www.Electionfraudremedy.com or www.lawyersforRonPaul.com    They already have over 400 delegates at all levels who have joined this suit. The only requirement is that your civil rights were violated in the voting process for President.   There is no charge and no downside. Please listen to the phone programs the lawyer has given ---another contact on the www.DailyPaul.com is Dr. K. Reserch....google him when you get to www.DailyPaul.com  nice guy. You are not alone.   We need your testimony.   Eventually there will be more suits filed including a RICO suit as we feel Romney/RNC has rigged all 50 states ad your experience is not unusual.   As for the RICO lawsuit we have many many videos and all kinds of evidence....even the payroll records from Romney's campaign showing he paid a Notre Dame graduate to distribute fake delegate slates at at least 2 conventions. Oh....Romney campaign people....we have the payroll records...AND at least 4 videos of the same guy. By the way---anybody else reading this---we know the voting rights of other supporters were also violated.   Our suit has Gingrich supporters, Bachman supporters, and Santorum supporters.    All of them are welcome as we know the other candidates had votes "influenced" also.    And voila the only person who every benefited was romney. That's romney with a  SMALL "r".

i have read about much fraud and cheating , i can tell you that in oregon the same crap is going on.  i applied for delegate and went to great efforts to make a video and comply with all the application requirements , when at the the convention my video was strangely "not working"  i asked if i could stand up and give it in person, i was grated much less time than the videos.  after the voting the observer said i had won alt delegate.   i was approached by many people i did not know who said they had one space open when they came to the meeting and they wanted me.   i was at one point surrounded by people who liked my words as i was a producer of food fuel and housing for many years, i think people like producers rather then big talking moochers.     anyway i called the district chair who said i won also. i told him i would not makee travel arrangements unless i heard from the gop in writing that i won.  the gop announced they would nulliy the vote and use a committee to "appoint " delegates.   they told us because one of the meetings went overtime it nullified all the alt delegate votes. we checked with the other districts and they all said they were told the same thing.  it looks like a dirty scam.   i spent much time money and effort to attend a meeting 170 miles away, believing that the gop was fair,  now i am hearing everywhere they are not.

In AZ they did not use electronic voting machines, like Diabold. They were regular Laptop computers connected to scanners that could scan double sided documents. The program was created, approved and then run by George Teegarden on May 12th and May 14th to count the ballots. From the very first elections in our CD Caucuses, the votes came back in error, yet this same program was insisted up on being used by the AZ GOP to count our votes, even though several of us insisted upon hand-counts to verify.  The issue continued with the At Large votes which were NEVER hand-count verified by the Ron Paul Campaign and Romney Campaign present even though both the At Large Delegates and Alternates votes that were calculated twice each came back with different results. Hand counting the ballots would have verified which count, if any, were correct. This was never even a consideration.   .....and that is just the beginning of our trouble in AZ

Remember the supremes basically gave Florida to Bush (he may of legitimately won it but we will never know as the recount was stopped). Even if this case has merit I doubt anything anything will come it. Just wondering, did Dr Paul's have a stated position on  Bush v Gore?

I told a Romney supporter that I couldn't support Romney because he was in favor of NDAA. This guy was handing out "vote for Romney" papers at the polling place and was a Romney campaign worker. He never even heard of the NDAA. What you have is a case of party loyalists that don't care what he stands for or what his past record is. They just vote for whoever Rience Priebus and the RNC decide they should vote for.

Now they also have a judge of elections from Austin Texas claiming vote fraud happened there too, by an actual flipping (sound familiar) of the vote totals. In a district where Ron Paul is very popular, an exit poll of all voters was taken and the percentage for Ron was minimum 66%. He got 12% after the fraud. Also, over 250 people voted at this location, only 118 votes were recorded by the GOP of Texas. The grassroots pro-bono group, Lawyers for Ron Pau,l is planning on filing RICO charges against the RNC for criminal conspiracy. Even lawyers work for free for Ron!
