Orange County Doctor Gets Hit with Two Medical Malpractice Lawsuits in Two Days

March hasn't been a great month for Dr. Minch K. Fong.

The Mission Viejo physician and surgeon is now also a defendant in Orange County Superior Court where two unrelated medical malpractice lawsuits have been filed against him.

In one case, the family of a dead man claims that Fong caused the fatality.

On March 14, lawyers for Susan Gralneck filed a 5-page lawsuit that claims Fong and the Laguna Hills-based South Orange County Hematology Oncology Associates, where Fong works, misdiagnosed her husband Alan's medical condition, provided substandard professional care and caused his death.

Two days earlier, Fong saw another medical malpractice lawsuit filed against him. This case, filed by Louise Cote and her husband Marc Raymond of Mission Viejo, alleges Fong provided substandard radiation treatment, caused a painful full body rash and made a serious medical decision about chemotherapy without consulting Cote.

According to that lawsuit, Fong's acts caused "great mental, physical and nervous pain and suffering" as well as additional medical costs.

Raymond and Cote seek at least $400,000 in damages.

Fong, a 1992 graduate of the University of California at San Diego School of Medicine, has not yet filed a formal response in court to the allegations. Online Internet patients reviews have generally been positive about Fong's work. One website hails him as a "Super Doctor." Records at the Medical Board of California show that Fong had no prior negative actions taken against him.

Both lawsuits have been assigned to Superior Court Judge Francisco Firmat.

In lawsuit-happy America, it is not uncommon for people to file such claims.  Of course the attorney is going to make the doctor out to be a complete incompetent or worse.  However, when the facts are presented in court, a large percentage of malpractice claims are dismissed. Perhaps the OC Weekly should write a few articles about people who file lawsuits that are ultimately thrown out, and include their photographs and occupations as well.

Come on Scott Moxley, sounds like you wrote a premature story just to have something to turn in.  Why not wait for the results and report on the entire story, once investigation is complete, instead of tarnishing this Dr.'s name knowing that bogus medical malpractice claims are so common.  Someone should write an article about you and your questionable decision making.

Sounds like BS to me.  Docs switch chemo as the patient's condition improves or worsens.  I doubt he forgot to tell them.

If there were (3) then this would make the Times for sure...(4) would be Oprah and Obama would have to comment on it

Yes, medical malpractice lawsuits are common. But what stands out in this situation is that Dr. Fong got hit twice in one week and one of the complaints alleges his conduct resulted in an unnecessary death. I don't know the validity of the claims. I do know that the allegations are serious enough to warrant a simple news story. If the doctor wins the lawsuits, we'll report those findings too.

Perhaps its just a nuance but did you notice it says he didnt consult with cote... But it never says he didnt consult with Raymond... You know the actual patient?

Hey, Mox...I'm with you...I think two malpractice suits in one week is significant for a medical doctor and does warrant some press coverage. Time will tell if the allegations are true...but for the moment I'm just ecstatic no one made any juvenile comments about the doctor's name. :-)

yep...that'll square things for him if he's proven not at fault in these two suits.

Exactly what does the name I choose to post under have to do with anything? I would think in this age of cyberstalking I would be encouraged to NOT use my real name...especially being a woman. And I was merely giving the commenters kudos for not lowering themselves to the juvenile level some of them usually do when they encounter a non-anglo name...have you read the comments sections in these blogs with any regularity?...Then you would know what I was talking about. Besides, given the serious nature of the accusations, poking fun at the doctor's name is completely inappropriate wheter it's Fong or Seuss or anything else.
