[UPDATED, With DA's Clarification of Sentencing] Deborah Pauly's Drunken Night Out!

• Is there any organized opposition to this woman?  Like a "Anyone but Pauly" campaign?  It is hard to believe she is running with her record of hate speech and so on.  There is obviously a place for her with a certain group in Villa Park but it isn't acceptable anywhere else is it?

As a condition of probation you are not to violate any laws. Such a violation could violate the terms of your probation and as a result the consequences could be very severe.   (2) Pay a fine of approximately $390.00 plus the state's penalty assessment fee. Generally speaking, THE PENALTY ASSESSMENT TRIPLES THE AMOUNT OF THE FINE. (3) Complete a 1st Offender Alcohol Program (Under AB541). (4) ADDITIONAL fines, fees, restrictions, and conditions are usually imposed.

• Gustavo, you should find out what the FULL fine is... 390 is probably for 1st charge of driving under the influence of drug or alcohol and then its another 1500 for operating a motor vehicle with a BAC over .o8 and then there is usually a third charge to go with it but I dont remember what it is.  If you look him up on the courts website since its public record you can see what he was charged with. 

• So the best OC can cough up is Pauly and Spitzer ...? Sheesh ... no wonder the state continues to percolate into a cesspool.

• Thanks to the ever-helpful Farrah Emami of the DA's office for clarifying. Having never been popped for DUI (knock on Formica), I based my assessment that it was a light sentence on someone near and dear to me saying he was out 10 grand after a first DUI offense. Maybe he needed a better lawyer?

•  $390 in fines for a dui???  I ran a red light in Santa Ana in July and got a $480 red light camera ticket in the mail (I won my case in court but that's besides the point) and that didn't include the fee for traffic school.  It would have been $530. That's pretty F'ed up that it could cost a person more money and time to run a red light by a milisecond than to drink and drive and crash your car!  You let the point from a red light stay on your record if you don't go to traffic school and it stays on for 3 years.  That's kind of like probation.  This doesn't add up.  Thank you for publishing this article. Why did it take a year though?? Oh and to go to traffic school kills a full day of your weekend.  No mention if this jerk had to do any classes?

• This $390 fine for DUI and accident (trying to leave scene of accident) resisting arrest. Ms Pauly and Hubby are damn luck they are white. If she was African American she would be in for a couple of years and her husband would be shot dead (or at least tasered) for resisting arrest (a DWB case).   I paid more for  a 1 point not coming to a complete stop on right turn (camera ticket) it cost me 456 + traffic school option fees + traffic school fees.

• I've met Deborah Pauly a number of times at events organized by the OCGOP.  I don't think it is fair for you to demean her the way you do in this article.  I've never seen her behave in this manner.

• I believe that the fine is correct, however, courts have assessment fees that run the fines into the $2,000.00 range. Classes are if you want to get your license back because driving is a privilege, not a right. Without involving a lawyer, the fines are pretty lax for the offense. Personal experience. In fact, after the DUI, my car insurance rates were cut in HALF because I had been overpaying for so long. I'd be curious to find out if he was held liable for damage to the curb. Now THAT would cost some money!

• 10k is what you can expect it to cost you in total with increased insurance and attorneys fees.  But currently 1st offense is $2100 fine, 6 month license suspension but you can get a restricted after 30 days. 4 month first time offenders class which will run on average of $500-$600 bucks and 3 years of informal probation meaning you don't have to check in with a probation officer.  Also, Zero tolerance for three years so if you get pulled over within that three years with ANY measurable amount of alcohol in your system immediate 2nd offense. And since your on probation it gives any officer who stops you automatic consent to conduct a search you or your car and they can subject you to a sobriety check without probable cause.  Source.  My mom... She works for the superior court... processes these all day long.   Just be glad we arent like Ohio which makes you get "party plates" different color license plates so everyone knows you've been popped.

• Refusing a test of blood alcohol is an admission of guilt under California's implied consent law, which basically says that since driving is a privilege and not a right, the cops have the right to test your blood alcohol any time they have probable cause to do so. So, assuming he continued to refuse the blood test after he was arrested, this is going to be very challenging to defend.
