Kelly Thomas Killing Prelude Didn't Involve Slidebar, Bar Owner Claims

The claim that a Slidebar Rock-N-Roll Kitchen employee may have inadvertently helped ignite the brutal, July 5 killing of a homeless man by Fullerton cops is not true, according to Slidebar co-owner Jeremy Popoff.

In a Dec. 29 phone message to the Weekly in response to months of seeking an interview, Popoff--who is also a guitarist for the band Lit--addressed the rumor involving the killing of Kelly Thomas.

"I can tell you it's not true," he said.

But in the same message, Popoff said he will not accept the paper's repeated invitations to field questions about the subject.

"I just don't want to participate," he said.

Multiple sources associated with the Slidebar have insisted that police launched their savage attack on an unarmed Thomas after receiving a phone call complaint from a bar employee who may have falsely accused the homeless man of breaking into vehicles.

In the aftermath of the killing, Fullerton PD acknowledged that officers responded to the Thomas scene following a telephone complaint, but they've refused to publicly share any related information. The department's response to our Aug. 30 California Public Records Act request for the information contained thick black lines of redaction concerning specific phone calls.

For four months, we've asked Popoff to confirm or deny the phone call claim, but until the Dec. 29 message, he and his publicist had steadfastly refused all interview requests.

"It's not that I'm hiding out from you," he said in his message. "I just don't want to participate in the story and all the crazy theories and all that. I can tell you it's not true, and this thing's going to trial here pretty soon, and the facts will come out."

Following a lengthy investigation into Thomas' death, District Attorney Tony Rackuackas charged Manuel Ramos with second-degree murder and Jay Cicinelli with involuntary manslaughter. The two face an upcoming trial sure to attract international attention.

the three homeless guy's that were killed were most likely killed by one of the Fullerton Cops involved in the Thomas killing.

That is a given. Someone is doing this to send a message to the homeless and I think it directly relates to the Kelly Thomas murder but what is going to happen is instead of one homeless guy hanging out in front of a business or park you're going to have a group of 3 or 4 and they're going to be armed with makeshift weapons, extremely scared, paranoid and quick to lash out.

I agree the cops deserve 100% of the blame for the beating...but if the police were called to the scene under false pretenses because a person under Popoff's employ falsely reported the vehicle break-ins (which is a crime!) is he not responsible for reporting what he knows?

They're not but from a business standpoint it wouldn't be in their best interest to simply ignore questions from bloggers, reporters and the community. These "rumors" are very specific and serious, if they were completely false or baseless I would imagine most business owners would be very vocal instead of churlish and dismissive.

And we can argue semantics all day long.  Its as simple as someone saying... I THINK there is someone breaking into cars and, I SAW someone break into cars. 

Also, where does it say that they (the Slidebar) are beholden to answer some bloggers questions? Lets really put this into context,  this isn't the LA times or Register or CBS news that are knocking on his door asking questions.  I love the weekly but I'm thinking Brandon Ferguson is feeling a little to entitled to answers. Brandon needs to stay in his shoes and stop acting like he's Ted Koppel.  

There are too many variables involved to place judgement or blame on the business. Did they call... didn't they call.. did they make a false report did they not?  Did they think there was something going on.. did their customers complain so that prompted a call?  None of us really know... On one hand we have a Blogger for the weekly who says they did.  On the other hand we have a bar owner who was slow to respond but who says no.Neither of which seem to me to be very credible.  But one thing we do have is video and audio proof and eyewitness accounts that in the course of their investigation two Fullerton cops failed in their duties to uphold the law and who willingly and wrongfully murdered Kelly Thomas. 

Anything else is just noise...

California Penal Code 148.5 says otherwise in respect to the caller's participation.

In all fairness this business is certainly in no rush to say "No, we never made the call", "We never called the police that day about Kelly Thomas", "We never talked to any officers personally in person, phone or text about Kelly Thomas breaking into cars" and  "these rumors about us or our employees calling the police are completely false".

Furthermore they are in no rush to reach out to Ron Thomas or even Fullerton Police for their help putting these "rumors" to rest. 

...I wonder why.

But in your silly little scenario.  It would be the cops fault. 

Look at the posts here... Look at whats being said... People are rushing to judge a business based on a rumor when we already have the people responsible facing charges.

909Jeff, lets say you're walking down the street with your hands in your pockets, listening to your ipod or mp3 player and I call the police and say that I "believe" that you were brandishing a handgun (because Im a sociopath) even though you never did. So, the police comes out and you're still walking, minding your own business and the police asks you to stop and show your hands of course they're behind you and you cannot hear them so you continue walking, they take this as none compliance, so they continue to give you commands. You finally hear them once the song you're listening to stops playing, you turn around and in shock quickly take your hands out of your pockets and at this point the officer opens fire leaving you with critical injuries.

In this scenario who do you think is responsible for what happened? Is it the caller, the guy walking down the street and/or the officer?

Uhhhh, it's called a false incident report. If you or I call the police to get them to come out and you or I lie to them and embellish the story, we'd get hit with a penalty. A penalty that can include jail time. Though, this sounds like it was in cahoots with the police as far as to the reason that type of call is made. That should become public knowledge. It is dirty. Dirty and shameful.

Fair enough. And though I know the person who called the cops didn't anticipate Kelly Thomas getting savagely beaten, they must have known the Fullerton PD would harass him...bad intentions are bad intentions. It's the fact that someone wanted Kelly Thomas out of the vicinity of the Slidebar so badly that they were willing to falsely report a crime...and for what? Because a local homeless man may have unnerved a few thin-skinned bar patrons?

To the cops and the DA.... Not the OC weekly. AND, even IF they did "embellish" the truth to get the cops to come out faster.  What would it matter?  No employee of the slide bar laid hands on Kelly... But the Fullerton cops did.  

Brandon has been distracted like a cat with a new shiny toy.  I don't really care about the slide bar like I said I've been there once and have no intentions of going back.  But I do know that regardless of if they made a call or not, going after them is a distraction. 

I don't get the fixation with the Weekly has with Slide bar... We know for a fact who did this... Its on video... There are eye witnesses... and they are going to court and will be judged by a jury of their peers.  And its those two dickhead cops.  Not a business that may or may not have called the cops.
