Officers Charged In Kelly Thomas Case Won't Be Paid

After next week, the two Fullerton officers charged in the Kelly Thomas beating death won't be getting paid. 

Kevin Hamilton, Fullerton's acting police chief, announced today his intention to put Cpl. Jay Cicinelli and Officer Manuel Ramos on unpaid administrative leave on Oct. 8.

In a written statement, Hamilton said he decided the officers' pay should be stopped "after consulting with our City Attorneys regarding law that is relevant to this area."

Hamilton said he couldn't release any other details, since it was a personnel matter, but added that Cicinelli and Ramos have until Oct. 7 to respond to the proposed decision. 

The other four officers, who weren't charged by the DA, are still on paid leave, pending the FBI's civil rights investigation and Michael Genacco's internal investigation, Hamilton said.

Lets see, if I am accused of committing a crime will my employer pay me my hourly wage while I am in jail or not working? No Way... not even if the alleged crime was work related, I mean an honest mistake, not a willful abuse of authority for personal gratification. No work, no pay, period! That is called fair. (and YES, I am a proud union worker)

And Yes, a person should be considered innocent until proven guilty IN COURT, but innocent taxpayers should not be responsible to pay wages that are not being earned, but if after an exoneration in criminal court, a civil court may award lost wages After proving they were innocent... (criminal court finds guilty or not guilty, not innocent)

Manuel and jay are dedicated public servants. Just like thier brethren in the OC Healthcare Agency, Clerk Recorders Office and the OC Public Works agency, these men and women put themselves at risk everyday. WE ARE UNION STRONG!

We stand behind these men, for in America we are innocent until proven guilty.

These men and women have families. It is the publics responsibility to support them in these hard times. Thats why organizations like the FPOA and the OCEA exist: to provide for thier members in tough times.

I think pay should have been stopped the day they were charged.

edwin, you are right of course about the innocent until convicted, but most of the ass holes like Soho, salluna, Godsmacked and Jeff would have done well in the old west where suspected cattle rustlers were hung from the nearest tree, guilty or not.  In the end, when a jury of the Fullerton Officers peers have spoken, guilty or innocent, the Justice System will have run it's course and worked.  While all those people are quick to give it out, I wonder how they would respond if they were on the receiving end?  My guess is that they would't be so quick to play the role of the "hangman."

Except that they are public servants who are supposed to uphold the highest standard of public trust, a trust they violated when they willfully assaulted a meager man and killed him!

They will have their day in court.  Unfortunately for them, WE KNOW THEY DID IT! there is no doubt!

Kelly Thomas has a family too... and its the public's responsibility to support its community, from vagrants as well as BAD COPS!   And the FPOA and OCEA exist to circle the wagons and ensure the continuity of the "Code of Silence" and keep the public shut out.
