Alejandra Hernandez, OC Homicide No. 26: Estranged Husband Accused of Shooting Her 9 Times

Prosecutors allege the 35-year-old Anaheim man waited for Alejandra Hernandez to leave her job at an Irvine day care for lunch Thursday afternoon before following her Ford Mustang to the quiet Turtle Rock cul de sac where she was murdered.
After 28-year-old Hernandez was repeatedly shot, Agosta is accused of getting back into the Volvo he was driving but being unable to start the engine. He is then alleged to have exited the Volvo, gone over to the body of Hernandez and kicked her once before fleeing on foot.

A friend who did not know about the shooting picked Agosta up in Irvine. The suspect was arrested by Irvine police at the friend's Mission Viejo home around 4:30 p.m. Thursday.
Agosta is charged with one felony count of special circumstances murder by lying in wait with a sentencing enhancement for the personal discharge of a firearm causing death. If convicted, he could spend the rest of his life in state prison without the possibility of parole.
The Orange County Register reports that Hernandez had taken out retraining orders against Agosta, who is accused to responding to one with this text message: "Your payback will come."
