LA FISCALÍA ACUSA A UN PAYASO PROFESIONAL POR VIOLAR A NIÑA DE 12 AÑOS DE EDAD EN 2002

SANTA ANA - El Fiscal del Condado de Orange acusó a un payaso profesional el viernes y hoy con nuevo cargos por violar a una niña de 12 años de edad en el 2002. Jose Guadalupe Jimenez, de 41 años de edad, de la ciudad de Anaheim, es acusado de dos cargos de delito mayor por actos inapropiados contra una menor de 14 años de edad, un delito mayor por asalto sexual calificado de una menor, y un delito mayor por un acto inapropiado forzado contra una menor de 14 años de edad. Él enfrentará una sentencia máxima de 25 años hasta cadena perpetua en prisión estatal si es condenado de todos los cargos. Jimenez fue arrestado por el Departamento de Policía de Fullerton el viernes, 25 de marzo del 2011, y está detenido bajo fianza de $1 millón. Él se presento en corte hoy y regresara para ser instruido de los cargos ante el juez el 22 de abril, 2011, en el departamento CJ-1, en la Cárcel Central de Santa Ana.
Jimenez trabajaba como un payaso que se llamaba "El Tin Marín," cual le dio acceso regular a menores de edad.
Durante la noche del 19 de enero del 2002, Jimenez, disfrazado como payaso, es acusado de acercarse a la víctima de 12 años de edad afuera del Taco Bell ubicado en las avenidas Lemon y Commenwealth en la ciudad de Fullerton. Él es acusado de jalar y meter a la víctima por las muñecas dentro su vehículo, y de conducirla a un lugar cerca la secundaria Ladera Vista. Él es acusado de violar a la niña dentro su carro. De ahí, Jimenez es acusado de conducir con la víctima hacia un hotel en Fullerton. Cuando Jimenez se estacionó, la víctima se escapó y corrió a una tienda para buscar ayuda. Se contactó a la Policía de Fullerton, quienes registraron la ADN de Jimenez en el banco ADN local y nacional.
Jimenez tiene otro caso pendiente por daño corporal a un menor en Noviembre del 2010, y será procesado por la Oficina del Abogado de la Ciudad de Anaheim. Para este caso, se registro la ADN del acusado y en Febrero del 2011, el Departamento de Servicios Científicos Forense del Alguacil del Condado de Orange (Orange County Sheriff Forensic Science Services) conecto Jimenez al caso del 2002.
La investigación sigue. Se solicita a todas las personas que se consideren ser víctimas a que se comuniquen con el Supervisor Investigador de la Fiscalía, Lou Gutierrez, al número (714) 347-8794.
El caso será procesado por la fiscal asistente Katherine David de la Unidad de Asalto Sexual.
UPDATE, MARCH 28, 10:19 A.M.: Ten minutes before the 10 a.m. scheduled arraignment of Jose Guadalupe Jimenez, the Orange County district attorney's office (OCDA) announced the filing of additional charges against the professional clown who performs as "El Tin Larin."
In addition to two felony counts of lewd acts upon a child younger than 14, the 41-year-old Anaheim resident now faces felony counts of aggravated sexual assault of a child and forcible lewd act on a child younger than 14 in the rape of a 12-year-old girl in Fullerton in 2002. The maximum sentence that can be imposed on Jimenez if convicted has also been increased to 25 years to life in state prison.
Meanwhile, the OCDA is searching for more possible victims.
The clown is currently being held on $1 million bail.
UPDATE, MARCH 28, 8:34 A.M.: The Orange County district attorney's office (OCDA) has announced the charges against Jose Guadalupe Jimenez, the 41-year-old accused of kidnapping and raping a 12-year-old girl in Fullerton nine years ago.
Jimenez, a professional clown who performs as "El Tin Larin," is shown in character at right. He allegedly wore his clown get-up while snatching and attacking his young victim. He faces two felony counts and could get up to 10 years in state prison if convicted.

PROFESSIONAL CLOWN CHARGED WITH COLD CASE SEXUAL ASSAULT OF 12-YEAR-OLD GIRL IN 2002

SANTA ANA - The Orange County District Attorney's Office is seeking the public's help identifying potential additional victims of a professional clown charged yesterday with sexually assaulting a 12-year-old girl in 2002. Jose Guadalupe Jimenez, 41, Anaheim, is charged with two felony counts of lewd acts upon a child under 14 and faces a maximum sentence of 10 years in state prison if convicted. Jimenez was arrested today by the Fullerton Police Department and is being held on $1 million bail. He is scheduled to be arraigned Monday, March 28, 2011, at 10:00 a.m. in Department CJ-1, Central Jail, Santa Ana.
Jimenez is a professional clown who goes by the name of "El Tin Marin," an occupation which has allowed him access to children.
On the night of Jan. 19, 2002, Jimenez, dressed as a clown, is accused of approaching Jane Doe outside of the Taco Bell on Lemon Avenue and Commonwealth Avenue in Fullerton. The defendant is accused of later committing lewd acts on Jane Doe near Ladera Vista Junior High School. The victim was able to escape for help. Fullerton Police were contacted and a DNA sample was collected and entered into the local and National DNA banks. The investigation into the facts of this case is ongoing.
Jimenez has an open case for corporal injury on a child from November 2010 and is being prosecuted by the Anaheim City Attorney's Office. The defendant's DNA was taken for this case and in February 2011, the Orange County Sheriff Forensic Science Services linked Jimenez to this case.

A professional clown was arrested today for allegedly kidnapping and raping a 12-year-old girl in Fullerton nine years ago.
Jose Guadalupe Jimenez, 41, is accused of having been in full makeup and costume at the time of the crime.
Shortly after midnight on Jan. 19, 2002, the girl was abducted and driven to a Fullerton school, where she was raped in the car while parked in the school lot.
Her attacker kept a clown mask and makeup on the whole time.
She was later driven to a motel, where she was again molested in the car. When the clown went to talk with the desk clerk, the girl managed to break away.
It became a cold case because the girl could not identify her attacker--other than to say he was a clown.
Jimenez, who performs as a clown under the name "El Tin Larin" and mostly in Latino communities, was arrested last year on an unrelated crime and a DNA sample was taken from him. A hit later came up in the crime database linking him to the 2002 kidnapping and rape, according to the Fullerton Police Department.
