California Pervert Guilty For Cyber Sex "Touching" of Fake 13-year-old Girl

Stillittano: Webcam superstar
Can you imagine the shock on Jeffrey Andrew Stillittano's face when he learned that he'd jacked off three times in two days on his webcam for Jamie, a 13-year-old girl who was, in fact, a fictitious character being played by undercover vice squad cops at the Anaheim police department?

Stillittano, a resident of Redondo Beach, found Jamie in an internet chat room, claimed he was 20 years old when he was 30, and proceeded to dirty talk after the girl said she was just 13.

He asked the child if she was naked, wet and touching herself, and turned on his webcam. He then exposed his penis, masturbated vigorously and ejaculated twice during the session.

The next day, Stillittano masturbated for her again on the webcam and, while making plans to meet at a hotel, ejaculated for a third time.

He never followed through with a meeting, but police, who had him under surveillance, charged him with two counts of attempting to commit a lewd act on a child under 14 and two counts of attempting to distribute harmful material to a minor. Interestingly, Aleta Bryant, a veteran Orange County prosecutor, argued Stillittano was guilty of "constructive touching" of the imaginary minor because, even though he was never in her physical presence, he had figuratively touched her by encouraging her to touch herself.

A 2009 jury agreed with Bryant, found Stillittano guilty on all counts, and Superior Court Judge Gregg L. Prickett sentenced him to prison.

But Stillittano appealed, arguing that he could not be guilty of attempting to commit a lewd act because he "did not implement a concrete criminal plan to physically touch Jamie."

This week, a California Court of Appeal based in Santa Ana rejected Stillittano's claim.

"There is ample evidence that [Stillittano] specifically intended to commit a lewd act on a child under the age of 14," wrote Justice William W. Bedsworth for a three-justice panel that included William F. Rylaarsdam and Kathleen O'Leary. "At the outset of his internet chat with Jamie, he asked her old she was, and was told she was only 13. Nonetheless, he persuaded her to engage in 'cyber sex' and encouraged her to touch her own genitalia. He also talked about how he wanted to 'fuck' her while he was masturbating in front of his webcam. There can be no question he had the requisite intent to arouse, appeal to, or gratify his sexual desires or those of the victim."

Upshot: Stillittano, now 35, will continue to serve his six-year prison sentence and then faces formal probation for another five years when he emerges from custody.

As much of a pervert as this guy is, I agree it was entrapment. There was no 13 year old and therefore no crime.

I'm in no way excusing pervy behavior but this type of sting is entrapment.

How do the movie makers get away with it?

Showing adult women and men pretending to be under age for the movies, having sex (pretend) and drugs (pretend) killings and murder (pretend).

Why are the movie makers and actors not arrested for their pretend crimes too?

Next thing they will pretend to be a "terrorist" and "bust" someone for terroist activities that were never committed. Be careful. Big Sis is watching under the guise of trying to keep us "safe".

Wacko Jacko......... I suggest making ropes available to inmates. Perhaps many would hang themselves if it was convenient. It would be their choice and save us tons of $ and prevent future crimes. Oh, and the "Pro-Choice" crowd would love it.

Is "Jacked off" now an official term in journalism? This article, the way it was written sickens me as much as the news content

Your posting nickname doesn't help your case.

Um yeah. If someone was planning to murder someone it would be better to catch them in the act..The intent was there...If a terrorist was planning to blow up a bunch of people it would be better to catch them before hand (again the intent was there.) AND if a old creepy guy tries to 'Seduce' 'Jack off' and possibly meet a 13 year old then its best to catch him before its to late..even if it was a fake girl it still doesn't matter because again the intent was still there..

Maybe because it's a blog associated with a news magazine.

In his mind, it was real. When the "imaginary" girl told him she was 13 years old, he should have just ended the chat, but he continued. He then went further to discuss meeting this "imaginary" girl. It's about his intent.

You, Mr. Pork, will be one of the many who will wave all their rights to freedom under the belief that the "government" of the United States will protect you. I'm sure all your thoughts and actions are as pure as the clear blue sky. When more are proscuted for "thought" crimes and the the goverment uses your weaknesses against you, you will see who is right. Be careful Porky.
