Bradley Stewart Wagner, Ex-Cop Who Forced Immigrants to Sex Him Up, Heads to Federal Court
Bradley Stewart Wagner, a former Anaheim police officer who was sentenced last month to four years in prison for forcing immigrant women to blow him lest he have them deported, has more legal entanglements ahead.
The 63-year-old Perris resident is due in federal court in Los Angeles on Feb. 22, when his trial for allegedly violating the civil rights of one victim begins.
U.S. District Judge Otis Wright II ruled Wednesday that Wagner is liable for damages and must stand trial.
A criminal trial is something Wagner and his lawyers managed to avoid for five years before he pleaded guilty in May to forcing two women to perform sex acts on him. Before his sentencing in Orange County Superior Court last month, Wagner tried unsuccessfully to withdraw his guilty plea. My colleague, R. Scott Moxley, was all over the case.
Wright ruled Wagner's original guilty plea in a criminal court cleared the way for him to face the federal civil trial, noting the burden of proof is higher in a criminal court than a civil one, reports the Orange County Register/City News Service.
Wagner, who besides coercing the two women to sex him up harassed a third woman while in uniform, could have received a nine-year prison sentence had the Superior Court judge applied the maximum penalty. Judge Walter Schwarm also granted a defense request that Wagner serve his time in protective custody.
