The Black Keys Sue Ad Agency Over Using Song To Promote a Bank

Billboard says the Black Keys are the latest band forced to sue over using songs without permission. Nonesuch Records, on behalf of the band, has filed two lawsuits in federal court against Della Femina Rothschild Jeary and Partners for using their hit "Tighten Up"--a song that's already been (legally) used in commercials--during the 2011 Grammy Awards to promote a New Jersey bank.

Nonesuch's lawyer is asking the judges to award damages "in proportion to the popularity of the song." That's a massively popular song, so we imagine they'll be owed quite a bit. The suit doesn't mention a specific dollar amount, but apparently the band is asking the judges to determine how much damage has been done in using its "hip cred" to promote a Garden State financial institution.
